The "presupuestos procesales" are one of the most important categories in civil procedure law theory that belongs to the civil law tradition. This institution can be defined as those procedural aspects that must exist in order to have a judgment about the claim presented by the plaintiff. This article searches for a different analysis of that institution, analysing it from the perspective of the procedure inefficiency, which according to the author is a categorie that includes the nullity.
