Aba Model Rule 8.4(G): National Adoption Is Long Overdue, Sara Rakowiecki

In 2016, the American Bar Association amended the Model Rules of Professional Conduct to include Rule 8.4(g) in an attempt to include a prohibition against discrimination and harassment with conduct related to the practice of law. While discrimination and harassment remain commonplace in the legal profession, many states refused to adopt Rule 8.4(g) which resulted in an unprecedented response to the ABA amendment. In this article, Sara Rakowiecki emphasizes the necessity for the legal profession to adopt and apply Rule 8.4(g) to cultivate a legal community where lawyers are consistently ethical and professional in the practice of law.

When Americans think of the criminal justice system, they picture a trial. The right to a trial by jury is supposed to undergird our entire justice system – but that bedrock constitutional right has all but disappeared thanks to plea bargaining. In 2018, more than 97 percent of defendants pleaded guilty.

The COVID-19 pandemic has exposed preexisting weaknesses in many areas of life and the law. In April 2021, the ABA published a study entitled Practicing Law in the Pandemic and Moving Forward: Results and Best Practices From a Nationwide Survey of The Legal Profession. The results of this study confirmed what many women and people of color already knew – standard approaches to the workplace do not serve goals of diversity and inclusion, especially during times of great stress and financial uncertainty.

Ending Injustice: Solving The Initial Appearance Crisis, Pamela R. Metzger, Janet C. Hoeffel, Kristin Meeks, Sandra Sidi

Most Americans expect that if they are arrested, they will quickly appear before a judge, learn about the charges, and have an attorney assigned to defend them. The reality is vastly different. After arrest, a person can wait in jail for days, weeks, or even months before seeing a judge or meeting an attorney. This report chronicles the resulting initial appearance crisis and highlights its devastating consequences. More importantly, it provides policymakers and advocates with actionable recommendations.

Evaluation Of Unm's Parental Leave Policy, Julia Fulghum, Karlyn A. Edwards, Charlie Christian, Steven Verney, Lisa A. Marchiondo, Teagan Mullins

Experiences with UNM’s parental leave policy C215 have been evaluated using the ADVANCE 2018 Main Campus Faculty Climate Survey, a series of junior faculty interviews, and concerns brought to the ADVANCE leadership. Key findings are:
- Women and STEM faculty are more hesitant to use family-leave policies, and perceive greater disadvantage in using them than men and non-STEM faculty
- Sharing of information about, and implementation of, parental leave varies significantly between units
- The attitude of the department chair and senior faculty strongly influence the experience of faculty who use parental leave
- Appropriately implemented, the parental leave policy contributes to faculty recruitment …

This book chapter, which was published in 2000, provides an overview of legal ethics education in U.S. law schools. Since 1974, legal ethics instruction has been required in law schools by the major accrediting body for law schools. The methods by which this requirement has been satisfied vary, but the result is a much richer ethics literature than existed previously and a variety of approaches to the topic. This book chapter begins with an overview of the regulation of U.S. lawyers. The second section discusses the history of the legal ethics course requrirement. The dynamic intersection of law and bioethics is a fruitful area of inquiry for purposes of knowledge generation, policy making and best practices. Reflecting a diversity of perspectives, this CLE will examine the crucial connection between law and matters bioethical in 2018. The program will include a focus on clinical decision making, palliative and end-of-life care, dispute resolution, medical and social science research, and informed consent and decision making.

This Fifth Edition of the ACTEC Commentaries continues the tradition of providing guidance on the Model Rules of Professional Conduct particular to estate and trust practitioners. The Fifth Edition update to the Commentaries takes account of amendments to the Model Rules adopted since the 2005 Fourth Edition, including those proposed by the American Bar Association Commission on Ethics 20/20 as adopted by the ABA in 2012 and 2013. It is current through August 31, 2015 as there have been no amendments to the Model Rules since 2013.
