Tax law is an ideal regulatory area for advanced legal research classes when you want to teach a comprehensive research topic putting together all of the various case, regulatory, legislative, and analytical sources that are needed in the real world. Since everyone pays taxes, tax is accessible and a good starting point to expend from the first-year common law focus, especially for those students resistant to regulatory research. New law students traditionally learn better when they can connect what they are learning to a familiar non-legal experience. Therefore, the use of an analogy, which can be defined as a comparison showing the similarities of two otherwise unlike things to help explain an idea or concept, is an obvious way to facilitate a student’s connection between the new and what is already known. Various authors have criticized the current bar exam format for not testing law practice skills. This is in spite of the ground-breaking MacCrate Report, the seminal publication of the practice-ready movement, which nearly 30 years ago listed ten fundamental practice skills. One of these ten Fundamental Lawyering Skills is legal research, which is still not tested on bar exams. The focus of this article will be on deficiencies pertaining to a lack of legal research readiness in the practice of law. Formatting topics included Table of Authorities, Table of Contents, page numbering, and styles. Students were encouraged to bring their laptops for hands on help with both Mac and PC versions of Microsoft Word.

Part I of this Article explores the United States justice system’s failure to adequately serve all people irrespective of wealth and position. Next, Part II discusses the ABA’s call to leverage technology to increase access to justice. Part III explores ABA Free Legal Answers Online, the program that the ABA pioneered to help confront the justice gap in the United States. Subsequently, Part IV illustrates how law schools can leverage technology to increase access to justice for low-income communities while providing pro bono opportunities for attorneys and students in their state. Designing Effective Legal Research Rubrics: The Foundation For Successful Assessment, Carol A. Watson, Katie Hanschke, Zanada Joyner

Increasingly librarians are teaching many, if not all, of the legal research courses at their law schools. Most librarians are not experts in education assessment design. Assessment with rubrics creates a learner centric environments in which instructors objectively evaluate student progress and assures that students receive consistent and meaningful feedback. Rubrics provide both students and instructors with a clear understanding of whether learning outcomes have been achieved. Guided by the instructors' experience and an in-depth review of the literature law librarians will be exposed to the best practices when creating rubrics including alignment with the course goals and instructor expectations.

Academic law librarians have long insisted on the value of autonomy from the university library system, usually basing their arguments on strict adherence to ABA standards. However, law librarians have failed to construct an explicit and consistent definition of autonomy. Lacking such a definition, they have tended to rely on an outmoded Langdellian view of the law as a closed system. This view has long been discredited, as approaches such as law and economics and sociolegal research have become mainstream, and courts increasingly resort to nonlegal sources of information. Finding The Theory And Method For The Pedagogy Of Teaching Legal Research: A Response To Callister's "Time To Blossom", Paul Jerome Mclaughlin Jr.

In his article “Time to Blossom,” Callister invites legal research experts to begin a discussion as to what theory and methodology would be most effective for teaching legal research. This article suggests that utilizing a tailored form of systems theory in conjunction with active learning methods would allow legal educators not only to teach students in an effective and understandable manner but also to adapt their teaching methods to correspond to changes in the legal research field.

Our students have to learn so many new skills to be successful in law school and law practice. Legal research, client interviewing, and case analysis just for starters. Our teaching methods have to engage our students while preparing them to “think like a lawyer.” We also have the responsibility to familiarize students in evaluating the “benefits and risks associated with relevant technology” and to develop efficient practices and processes. Finding legal information in the United States can be difficult and/or confusing for the layperson. Electronic databases such as LexisNexis or Westlaw may only be accessible for those who can afford it. Even with access to these databases, those without legal training may find them to be overwhelming. This chapter aims to shed some light on the process of doing federal legal research as well as recommend Internet sites where the layperson can get access to free legal resources.

Online education continues to rise in popularity for both undergraduate and graduate education. Among the reasons commonly stated for this preference is flexibility, both of time and location. It came as little surprise, therefore, when our Law Library’s long-term proposal to develop an online advanced legal research course found itself on the fast track. First-year associates will spend forty-five percent of their time on legal research; second- and third-year associates will spend thirty percent. And unfortunately, employers find their associates’ research skills lacking. This is not a new complaint. Employers have been complaining for more than a hundred years that recent law graduates cannot research well. None of this is lost on those who teach legal research, who have long debated the best way to do so. We construct our conceptual world using metaphors. Yet sometimes our concepts are flawed and our metaphors do damage. This Article examines a set of metaphors currently doing damage in law – those for legal research. It shows that while technology has radically altered the material world of legal research, our dominant metaphors have remained static, and thus, become outmoded. Conceptualizing today’s reality using old metaphors fails; it is like pouring new wine in old wineskins. Being a cost-effective researcher is not necessarily just about the legal research resources available where an attorney practices. Budgetary concerns are prevalent across all legal markets, from solos and public interest to large law firms. As the legal field struggles with clients who want greater efficiencies from their attorneys and alternative fee arrangements, many of which state that attorneys will not bill clients for legal research database fees, it is becoming more important than ever to teach law students and attorneys how to use alternative resources effectively and efficiently.
