Clark Kerr And Me: The Future Of The Public Law School, Rachel F. Moran

Clark Kerr has long enjoyed an iconic status among leaders in public higher education. The former president of the University of California left a lasting impression on the academic world with his Godkin Lectures on the future of colleges and universities delivered at Harvard in 1963. He spoke at a moment when public higher education, and indeed higher education more generally, had been enjoying a renaissance of energy and vision. From Roach Powder To Radical Humanism: Professor Derrick Bell's 'Critical' Constitutional Pedagogy, Vinay Harpalani

This essay is a tribute to the late Professor Derrick Bell, who passed away on October 5, 2011. The author was the Derrick Bell Fellow at New York University School of Law in 2009-10 and assisted Professor Bell in teaching his constitutional law courses. The essay discusses Professor Bell's 'critical' constitutional and life pedagogy, by giving illustrations from Professor Bell's classes and anecdotes from several of his former students. It highlights not only Professor Bell's comprehensive approach to constitutional law, but also the "radical humanism" he brought to teaching and mentoring students.

Neil Komesar’s work has transformed our understanding of how institutional analysis should be done. There is one very surprising omission from the breathtaking range of Komesar’s oeuvre, however: he has never directly applied his framework to crises. My aim in this Article is to advance, at least in a small way, our understanding of institutional choice during and after an economic crisis. Part I very briefly revisits the recent crisis, emphasizing its institutional dimensions. Part II identifies three puzzles posed by a crisis for standard Komesarian analysis. Justice Kennedy's Sixth Amendment Pragmatism, Stephanos Bibas

This essay, written as part of a symposium on the evolution of Justice Kennedy’s jurisprudence, surveys three areas of criminal procedure under the Sixth Amendment: sentence enhancements, the admissibility of hearsay, and the regulation of defense counsel’s responsibilities. In each area, Justice Kennedy has been a notable voice of pragmatism, focusing not on bygone analogies to the eighteenth century but on a hard-headed appreciation of the twenty-first. He has shown sensitivity to modern criminal practice, prevailing professional norms, and practical constraints, as befits a Justice who came to the bench with many years of private-practice experience. “Professionalism.” This is a word that will always be associated with Justice Carrico—not only because he was a consummate professional himself, but also because he was dedicated to assuring that all lawyers understood the full ethical, social, and behavioral implications of their role as lawyers. Under his leadership, Virginia became the first state to require all newly-admitted lawyers to take a day-long course in professionalism. It is a model that has been widely emulated around the country.
