The Shrinking Back: The Law Of Biography, Mary Sarah Bilder

The Article argues that quotations of copyrighted material used as "fact" should be protected. The Article explores the relation between the legal law of biography and the literary theory of biography, focusing specifically on the use of unpublished materials in written biographies. The Article surveys the assumptions underlying copyright, fair use, and privacy doctrines. The Article critiques fair use solutions suggested by legal commentary and congressional action and sketches a different analysis, not involving fair use. The "fact use" proposal would shift the burden from proving "fair use" to proving that the quotations were not used as "facts."

In 1973 I served in my first session of the General Assembly of Virginia. Prior to leaving for Richmond, I was advised to keep my mouth shut and to never, never raise the ire of A.L. Philpott. We had some problem in Mecklenburg County, and I introduced legislation to address it. As the bill was called on second reading, I shuddered as Mr. Philpott rose and asked the Speaker if I would yield for a question. He asked: "Does the gentleman realize the bill is in violation of the Constitution of Virginia?" Since I am not an attorney, I had …

After Fordham University moved the School of Law to the cultural hub at Lincoln Center, the problems associated with our urban areas began to accelerate. It became apparent that a closer focus had to be directed specifically at the urban problems of the nation, with particular emphasis on the affairs of its then largest city and state - New York. Thus, the Fordham Urban Law Journal (ULJ or Journal) published its first issue in 1972, exactly 20 years ago.
