The Shrinking Back: The Law Of Biography, Mary Sarah Bilder Jan 1992

The Shrinking Back: The Law Of Biography, Mary Sarah Bilder

Boston College Law School Faculty Papers

The Article argues that quotations of copyrighted material used as "fact" should be protected. The Article explores the relation between the legal law of biography and the literary theory of biography, focusing specifically on the use of unpublished materials in written biographies. The Article surveys the assumptions underlying copyright, fair use, and privacy doctrines. The Article critiques fair use solutions suggested by legal commentary and congressional action and sketches a different analysis, not involving fair use. The "fact use" proposal would shift the burden from proving "fair use" to proving that the quotations were not used as "facts."

A Tribute To A.L. Philpott, Lewis W. Parker Jr.

University of Richmond Law Review

In 1973 I served in my first session of the General Assembly of Virginia. Prior to leaving for Richmond, I was advised to keep my mouth shut and to never, never raise the ire of A.L. Philpott. We had some problem in Mecklenburg County, and I introduced legislation to address it. He asked: "Does the gentleman realize the bill is in violation of the Constitution of Virginia?" Since I am not an attorney, I had …

The Fordham Urban Law Journal: Twenty Years Of Progress, Constantine N. Katsoris

Fordham Urban Law Journal

After Fordham University moved the School of Law to the cultural hub at Lincoln Center, the problems associated with our urban areas began to accelerate. Thus, the Fordham Urban Law Journal (ULJ or Journal) published its first issue in 1972, exactly 20 years ago. This article commemorates the 20th anniversary of the Urban Law Journal, reflecting on the Journal's most notable accomplishments and tracing its …
