Oliver Wendell Holmes, Jr., And The American Civil War, Catharine P. Wells Oct 2015

Oliver Wendell Holmes, Jr., And The American Civil War, Catharine P. Wells

Catharine P. Wells

Oliver Wendell Holmes, Jr. spent three terrible years fighting in the Civil War. By any standard his experience was horrific. He was wounded three times, suffered a nearly fatal bout of dysentery, and endured the deaths of many of his closest friends. Without doubt, it was the most affecting period of his life. Unfortunately, however, the accounts of Holmes’ wartime experience have been notably superficial. Part of the problem has been the fact that, until recently, the chief source of information about these years was Holmes’ own diary and letters. The difficulty with these as a source has been twofold. …

Helping A Lawyer To Understand What It Means To Think Like An Architect, Kevin Emerson Collins Oct 2015

Helping A Lawyer To Understand What It Means To Think Like An Architect, Kevin Emerson Collins

Michigan Telecommunications & Technology Law Review

Professor Radin unquestionably influenced legal academia through her ideas, arguments, and scholarship. With that said, my tribute is decidedly personal. To me, Professor Radin was the mentor and role model that I sorely needed when I was figuring out what being a legal academic could mean for me.

Asking The Nearest Hippie, Shubha Ghosh Oct 2015

Asking The Nearest Hippie, Shubha Ghosh

Michigan Telecommunications & Technology Law Review

It is an honor to be asked to contribute to this Symposium in honor of Margaret Jane Radin. It is particularly exciting to be able to engage with her scholarship during the summer of 2015 (the time this essay was written) when so many compelling legal issues are coming to a head: same sex marriage and the recognition of dignity as a constitutional value, pragmatic treatment of controversial regulation such as the Affordable Care Act, the death penalty under scrutiny as two justices unequivocally reaffirm its unconstitutionality, voting rights protections roll back, police brutality against African-American citizens as a daily …

Peggy Radin, Mentor Extraordinaire, R. Anthony Reese Oct 2015

Peggy Radin, Mentor Extraordinaire, R. Anthony Reese

Michigan Telecommunications & Technology Law Review

I write to celebrate Peggy Radin’s contributions to the legal academy in her role as a mentor. I know that others will speak to her significant scholarly achievements and important contributions across several fields. I want to pay tribute to the substantial time and energy that Peggy has devoted over the course of her career to mentoring students and young academics. I was extremely fortunate to have had a handful of mentors who helped me become a law professor. (I am also extremely fortunate that some of those mentors became generous senior colleagues who occasionally continue to help me navigate …

Contracts, Persons And Property: A Tribute To Margaret Jane Radin, Ruth L. Okediji Oct 2015

Contracts, Persons And Property: A Tribute To Margaret Jane Radin, Ruth L. Okediji

Michigan Telecommunications & Technology Law Review

In 2011, the United States was only just beginning to emerge from what some claimed to be the most significant economic crisis since the Great Depression. The devastation wrought by unregulated subprime mortgages unfolded as a political, legal, financial and social tragedy. Millions of homeowners had purchased homes for amounts they most certainly could not afford, with terms and conditions written on documents they even more certainly had never read. Many of those most severely affected were, as one might expect, racial minorities and underrepresented groups, but plenty of other members of society were also caught in the intricately woven …

Book Review: To Set The Record Straight By Judge John J. Sirica, Richard L. Aynes Jul 2015

Book Review: To Set The Record Straight By Judge John J. Sirica, Richard L. Aynes

Akron Law Review

One of the recent and more worthy accounts is that presented by Washington D.C. District Court Judge John Sirica in his To Set the Record Straight. Judge Sirica's sixteen chapters generally cover five topics: 1) a prologue outlining his early experiences and how he attained his position of federal district judge; 2) the first Watergate break-in trial; 3) Judge Sirica's attempt to "break" the silence of the cover-up following the initial proceeding; 4) the controversy over the production of the Presidential tapes; and, 5) the ultimate trials of Nixon administration officials for conspiracy to obstruct justice.

A Tribute To The Honorable Oscar A. Hunsicker, William P. Kannel, William H. Victor, Robert D. Moss, Richard L. Aynes

Akron Law Review

Judge Hunsicker was elected to the Juvenile Court bench in 1930. He was a pioneer in the changing of Juvenile Courts and was primarily responsible for much of a lasting philosophy and many lasting procedures of our present day Juvenile Court. He served in that court until 1946 when he was elevated to the Ninth District Court of Appeals. His record as an outstanding Jurist is common knowledge.

The article will discuss Adams's legal education, his early legal practice, his reasons for declining an appointment to the Supreme Court, and his role as counsel in various cases decided by Supreme Court. Adams's legal education provides insight into the nature of legal training in late eighteenth century America and the legal profession during the late eighteenth and early nineteenth centuries. Finally, Adams's career at the Bar provides a means of evaluating various theses that have been advanced concerning the influence of legal training on the performance of presidents in office.

Tedxund: An Escape Strategy For The War On Crime: Healing The Criminal, Tedx, David T. Link

1975–1999: David T. Link

People in prison are more than the crimes they commit, declares Rev. David, Link, a professor emeritus of Notre Dame Law School. Drawing on his experiences both in law and in prison ministry, he was inspired to plan an escape strategy for the so-called War On Crime. Put simply: Heal don’t punish.

Joseph Sax, A Human Kaleidoscope, Zygmunt J.B. Plater Feb 2015

Joseph Sax, A Human Kaleidoscope, Zygmunt J.B. Plater

Zygmunt J.B. Plater

Probably more than any other person most of us will ever have the opportunity of knowing, Joe Sax was kaleidoscopic in the way he projected his mind and lived his life as a scholar, teacher, and citizen seer. Shifting his analytical gaze from challenging context to challenging context, he repeatedly threw rich new patterns of perceptive light, thoughts broad and deep, onto a remarkable range of puzzles. Joe’s ability to think broadly and deeply influenced and reshaped the way that his students, friends, colleagues, and readers understood the intricacies, beauty, and challenges of the world around them. Others in this …
