Holmes' Failure, Louise Weinberg
Holmes' Failure, Louise Weinberg
Michigan Law Review
I have just set down the March 1997 Harvard Law Review, with its centennial celebration of Oliver Wendell Holmes' The Path of the Law. The Path of the Law is a grand thing, in my view Holmes' best thing. But just the same, I find myself surprised that on this occasion none of its celebrants raised what has always seemed to me a weakness of the piece, and of Holmes' much earlier book, The Common Law. This is a weakness that is at once a reflection and a forecast of the failure of its author. Writers today do seem to …

This Indian law symposium issue of the Washington Law Review was inspired by the work of Professor Ralph W. Johnson, whose teaching and personal commitment to the field have motivated hundreds, if not thousands, of law students. The decision of the Editorial Board to dedicate the symposium to him might have been made by as many as thirty classes that have passed through the University of Washington School of Law. Those students have been introduced to and moved by Professor Johnson's elucidation of a field that is at once intellectually challenging and morally significant. Johnson's alumni have spread over the …

We recall a summer of contentment when American law was suffused with optimism, a season ending a long winter of despair and disorder. For the first fifteen years of this century, many (and perhaps most) American lawyers were filled with confidence that America had healed the wounds of civil war and was healing those of class struggle. We could, and we would, overcome all obstacles to peace and prosperity, not only for our people but for all mankind. This, it was widely believed, would be our century. As early as 1879 Daniel Coit Gilman, the premier educator of his time, …

This Article examines the 1982 film Gandhi. Although it took factual liberties with Gandhi's life, Professor DiSalvo concludes that it accurately conveyed Gandhi's dedication to self-suffering and philosophy of non-violence. The Article analyzes excerpts from the film which illustrate Gandhi's five fundamental beliefs on the spirituality and politics of suffering. Those beliefs are in suffering as a weapon, as empowerment, as self-interest, as propaganda, and as reconciliation. The film Gandhi also masterfully introduced millions to Gandhi's life, message, and legacy.
