The Vehicle Miles Tax: The Unintended Consequences Of Paying As You Drive, Gregory A. Lush

3. A Vehicle Miles Tax Reduces Manufacturer Incentives to Build Electric Vehicles

It follows that if consumers have few incentives to buy electric vehicles, manufacturers will have less of an incentive to make them. If electric cars were not in demand, then why would anyone make them and try to sell them? In a market that is finding electric vehicles to be a tough sell, we need to encourage the sale and production of electric vehicles as much as possible. The effect of enacting a mileage-based tax will be the attrition of automakers producing electric vehicles, furthering the nation’s dependency …

The Value Of Government Mandated Location-Based Services In Emergencies In Australia, Anas Aloudat, Katina Michael, Roba Abbas, Mutaz M. Al-Debei Dec 2011

The Value Of Government Mandated Location-Based Services In Emergencies In Australia, Anas Aloudat, Katina Michael, Roba Abbas, Mutaz M. Al-Debei

Dr. Mutaz M. Al-Debei

The adoption of mobile technologies for emergency management has the capacity to save lives. In Australia in February 2009, the Victorian Bushfires claimed 173 lives, the worst peace-time disaster in the nation’s history. The Australian government responded swiftly to the tragedy by going to tender for mobile applications that could be used during emergencies, such as mobile alerts and location services. These applications, which are becoming increasingly accurate with the evolution of positioning techniques, have the ability to deliver personalized information direct to the citizen during crises, complementing traditional broadcasting mediums like television and radio. Indeed governments have a responsibility …

Overview Of The Core Changes In The New Ethiopian Urban Land Leasehold Legislation, Belachew M. Fikre Dec 2011

Overview Of The Core Changes In The New Ethiopian Urban Land Leasehold Legislation, Belachew M. Fikre

Belachew M Fikre

Rural land administration has shown a significant improvement, inter alia, due to the implementation of the possession certification process. Whether or not this process of certification would bring the desired goal of 'sustainably conserving and developing natural resources and pass over to the coming generation through the development and implementation of a sustainable rural land use planning' is yet to be seen. This progress in the rural land administration is not matched by the urban land holding system. It is rather perplexing that the total houses in Addis Ababa without title deeds are more than the ones with title deeds. …

Las Pretensiones De Responsividad Del Derecho Del Trabajo Y El Juez Laboral, Sebastián A. Pizarro Oct 2011

Las Pretensiones De Responsividad Del Derecho Del Trabajo Y El Juez Laboral, Sebastián A. Pizarro

Sebastián A. Pizarro

The Rise Of National Regulatory Autonomy In The Gatt/Wto Regime, Michael Ming Du Oct 2011

The Rise Of National Regulatory Autonomy In The Gatt/Wto Regime, Michael Ming Du

Michael Ming Du

This paper sets forth two arguments. First, to respect a WTO Member’s national regulatory autonomy in the world trading system is essential to ensure the WTO’s long term success in light of the WTO’s institutional constraints, the WTO’s underlying philosophy and the WTO’s nature as an incomplete contract. Second, and contrary to many popular criticisms against the WTO’s allegedly intrusive penetration to national regulatory autonomy, this paper argues that these critics have failed to appreciate the recent WTO case law developments. Indeed, the recent WTO case law has shown that the WTO Appellate Body has quietly fine-tuned its previous jurisprudence …

Unanswered Questions Of A Minority People In International Law: A Comparative Study Between Southern Cameroons & South Sudan, Bernard Sama Mr

Bernard Sama

The month July of 2011 marked the birth of another nation in the World. The distressful journey of a minority people under the watchful eyes of the international community finally paid off with a new nation called the South Sudan . As I watched the South Sudanese celebrate independence on 9 July 2011, I was filled with joy as though they have finally landed. On a promising note, I read the UN Secretary General Ban Ki-moon saying “[t]ogether, we welcome the Republic of South Sudan to the community of nations. Together, we affirm our commitment to helping it meet its …

Requerimientos Empresariales De Flexibilidad Y Conflicto Laboral: Por Una Congruencia Entre Derecho, Economía Y Sociedad., Sebastián A. Pizarro Aug 2011

Requerimientos Empresariales De Flexibilidad Y Conflicto Laboral: Por Una Congruencia Entre Derecho, Economía Y Sociedad., Sebastián A. Pizarro

Sebastián A. Pizarro

De La Admiración A La Recepción Crítica: El Apagado Eco De La Codificación Del Derecho Privado Europeo En América Latina, Leysser L. Leon

Role Of University Law Clinics In Delivery Of Legal Aid, Maurya Vijay Chandra Jun 2011

Role Of University Law Clinics In Delivery Of Legal Aid, Maurya Vijay Chandra

Maurya Vijay Chandra

University Law Clinics as a tool for sensitising the young students towards the needs of the poor and as an engine of meeting the legal services' needs of the under-privileged has been vigorously canvassed at least since the 1960s. It has been assumed that the law students would be ever so willing to gather some practical training before she/he jumps into the profession that the availability of student time will not be difficult. Yet, after two commissions on legal aid. Centre for Implementation of Legal Aid Schemes (better known as CILAS); the National Legal Services Authorities Act and an elaborate …

Legal Outlier, Again? U.S. Felon Suffrage: Comparative And International Human Rights Perspectives, Reuven (Ruvi) Ziegler

Dr. Reuven (Ruvi) Ziegler

The judiciousness of American felon suffrage policies has long been the subject of scholarly debate, not least due to the large number of affected Americans: an estimated 5.3 million citizens are ineligible to vote as a result of a criminal conviction. This article offers comparative law and international human rights perspectives and aims to make two main contributions to the American and global discourse. After an introduction in Part I, Part II offers comparative law perspectives on challenges to disenfranchisement legislation, juxtaposing U.S. case law against recent judgments rendered by courts in Canada, South Africa, Australia, and by the European …

Corporate Obligations Under The Human Right To Water, Jernej Letnar Cernic Mar 2011

Corporate Obligations Under The Human Right To Water, Jernej Letnar Cernic

Jernej Letnar Černič

Almost a billion people do not have access to clean and safe water. Access to safe drinking water and sanitation is increasingly being considered a fundamental human right. Corporations play an important role in the realization of the right to water. For example, they can become violators of the right to water where their activities deny access to clean and safe water or where water prices increase without warning. Corporations can have a positive or negative impact on the human rights of individuals, wider communities and indigenous peoples. This paper argues that corporations bear a certain responsibility for the realization …

Reflections On Teaching Law, Michael Lp Lower Feb 2011

Reflections On Teaching Law, Michael Lp Lower

Michael LP Lower

This essay reflects on the goals of law teaching. It suggests that a commitment to scholarship and to inspiring others to become scholars is at the heart of law teaching. It makes suggestions as to how this can be achieved effectively and on the way that web 2.0 technologies can help. It also points out that a commitment to open access is not also consistent with the University's mission but can also be of economic benefit to the University.
