Today’s complex sociopolitical context features an increasing determent of fundamental bipartisan principles and negotiation at both the federal and state levels of government. A competitive political environment akin to post-Civil War times, amplified by growing partisan polarization and politicians’ quest for party allegiance and self-reward, pervasively discourages productive compromising efforts to work across the isle. We believe this hinders government’s sole and rather straightforward fiscal duty: to provide stable, healthy, and predictable economic conditions for its constituents. Pablo Escobar was a Colombian drug lord and leader of the Medellin Cartel which at one point controlled as much as 80% of the international cocaine trade. He is famous for waging war against the Colombian government in his campaign to outlaw extradition of criminals to the United State and ordering the assassination of countless individuals, including police officers, journalists, and high ranking officials and politicians. He is also well known for investing large sums of his fortune in charitable public works, including the construction of schools, sports fields and housing developments for the urban poor. In December 2003, the United States Supreme Court upheld all the key provisions of the Bipartisan Campaign Finance Reform Act (BCRA) of 2002. In their 5-4 decision, the justices deferred broadly to the limitations set by Congress on unregulated “soft money” and “issue ads” in political campaigns. Derek Langhauser, who worked in Senator Olympia Snow’s office as counsel in McConnell v FEC, as this case was called, gives a legal history of the challenge of balancing Congress’ interest in protecting the integrity of elections with the Constitution’s competitive rights of free speech and association.
