Mandatory Ultrasounds And The Precession Of Simulacra, Jessica Knouse

The term “precession of simulacra”—coined by French philosopher Jean Baudrillard to describe the postmodern phenomenon wherein “images precede reality”—accurately describes what is wrong with the pre-abortion ultrasound mandates that have recently been enacted in a number of states. The term captures the idea that the traditional reality–image hierarchy has been inverted and repeatedly re-inverted to the point where the boundary between the two has become blurred. Laws that require doctors to display and describe sonograms prior to performing abortions exploit this blurring by encouraging women seeking abortions to experience fetal images more vividly than they experience the realities that lead …

A trend of rights advocacy has recently developed in the international community. Organizations dedicated to the principle of advancing the rights of historically under-represented and oppressed social groups have proliferated around the globe. The growth of the gay rights movement in recent years has resulted in the expansion of civil liberties afforded to same-sex couples. The movement has gained significant success in symbolic expression. Even without much knowledge of the movement, one typically associates a rainbow flag, the Greek letter lambda, and the word “pride” with the effort. Sexual Liberty And Same-Sex Marriage: An Argument From Bisexuality, Michael Boucai

This article proposes that same-sex marriage bans channel individuals, particularly bisexuals, into heterosexual relationship and relationships, impermissibly burdening sexual liberty interests protected under Lawrence v. Texas. A claim from sexual liberty departs dramatically from the legal paradigms and advocacy strategies that currently dictate the terms of constitutional debate on this issue. This article proceeds in four parts. Part II develops the legal argument that same-sex marriage bans are unconstitutional under Lawrence because they substantially burden the right to choose homosexual relations and relationships. This Comment explains why the prohibition of widespread rape should be recognized as a jus cogens through analyses of the failure of existing international legal instruments, advances within international law towards the universal prohibition of widespread rape, and policy reasons for classifying widespread rape as a jus cogens. This Article looks at the MOBI in the United States through the lens of international human rights. Part II will describe the MOBI. Part III will evaluate the MOBI within an international human rights framework. Part IV will examine current U.S. legislation relating to the MOBI. Part V suggests strategies for addressing the MOBI. Nations will not be able to solve the problem independently because the MOBI is a transnational phenomenon. Finding Fundamental Fairness: Protecting The Rights Of Homosexuals Under European Union Accession Law, Travis J. Langenkamp

In tackling the issue of sexual orientation discrimination, the European Union must make significant efforts to conform or, perhaps, eradicate incongruous legislation within Applicant Countries. The difficulty of this endeavor is two-fold: first, in terms of the number and complexity of the laws of each Applicant Country; and, second, in the absence of any detailed and systematic documentation of sexual orientation discrimination within those same Applicant Countries. Compounding, if not confounding, such legitimate endeavors are the inconsistent anti-gay legislation prevalent within the present Member States. This Casenote analyzes the significance and potential effects of the decision in Harris v. Forklift Systems, Inc., a Supreme Court case decided in November 1993. This case promulgates a framework for analysis of "hostile environment" sexual harassment claims arising under Title VII of the Civil Rights Act of 1964. The author sets forth the historical backdrop of the case, as well as exploring and comparing the effect of the decision in general with the decision's effect in the Ninth Circuit in particular.
