The Virginia Sea Grant program approached VCPC to conduct research in partnership with the William & Mary Public Policy Program and a James Madison University (JMU) architecture professor, Jori Erdman. Professor Erdman is researching the viability of creating land with artificial oyster rings based on similar projects seen in Louisiana. Professor Erdman has provided the diagrams of the project used throughout this paper. Ultimately, this paper examines some legal issues raised by the use of these rings to prevent coastal erosion or act as a flooding buffer for commercial or residential buildings. Human beings should live in places where they are most productive, and megacities, where information, innovation, and opportunities congregate, would be the optimal choice. Yet megacities in both China and the United States are excluding people by limiting the housing supply. Why, despite their many differences, is the same type of exclusion happening in both Chinese and U.S. megacities? Urban law and policy scholars argue that Not-In-My-Back-Yard (“NIMBY”) homeowners are taking over megacities in the U.S. and hindering housing development. The most notable, or at least the most noted, form of property evolution has been the transfer of exclusive rights from collectives to individuals and vice versa, such as the farm collectivization in Soviet Union and the establishment of the People’s Communes in Mao’s China and their reversals. Such radical moments, however, constitute only a small part of history. For the most part, property rights evolve quietly and incrementally, which is hard to explain if we take exclusive rights as the core of property, or, to put it more generally, if we are focusing solely on the question of who …

This paper considers possible answers to these difficult questions by focusing on two issues: the evolution of legal norms in response to both endogenous and exogenous changes, and the role that African customary law and indigenous dispute resolution has played in promoting coordination and cooperation among group members, thereby reducing violent conflict. This paper explores legislative actions taken by the Nigerian government that impede the continued evolution of these relatively elastic customary legal norms. Bolivia's National Revolutionary party (MNR) seized power in April 1952 and a year and a half later in August 1953 promulgated the agrarian reform law, which redistributed the land of the haciendas to the former Indian tenants and others. This comparative economic study of the haciendas and ex-haciendas in the Lake Titicaca region of Bolivia and Peru was undertaken to answer three important, but largely unresolved, questions about land reform: (1 ) Which land-tenure system-large estates or small peasant farms-affords the agriculture laborers and cultivators the greater freedom of mobility, opportunity, income, and education? In April of 1952, the Movimiento Nacionalista Revolucionario, seized power in Bolivia and in August of the following year passed the Decreto de la Reforma Agraria and proceeded to redistribute the land of the latifundios to the former Indian laborers. This paper intends to analyze the economic and socio-economic consequences of this Bolivian revolutionary land redistribution by means of a comparative study of Peruvian haciendas and Bolivian ex-haciendas in the Lake Titicaca region.
