Vietnam's Contemporary Battle With The United States: Vying For Most Favored Nation Trading Status, Davis Frye

Vanderbilt Journal of Transnational Law

Since the United States and Vietnam signed the Paris Peace Agreement of 1973, Vietnam has sought to normalize economic relations with the United States in hopes of gaining American capital and technology. After the Vietnam War, however, the United States imposed a trade embargo against Vietnam and passed legislation denying that country non-discriminatory trading status. Moreover, Vietnam's past human rights abuses and its previous unwillingness to resolve American MIA/POW issues made its ambition of normalized U.S. relations an improbability. Recently, however, in response to Vietnam's renewed cooperation with U.S. foreign objectives, President Clinton has lifted the trade embargo against that …

Cooperative Standard Setting: The Road To Compatibility Or Deadlock? The Nafta's Transformation Of The Telecommunications Industry, Karen E. Lee

Federal Communications Law Journal

In an effort to reduce nontariff barriers, the North American Free Trade Agreement (NAFTA) directs its three member nations to utilize product standards set by international standard-setting organizations. What were once considered "permissible standards" are now mandatory standards as Articles 904-906 of the NAFTA mandate the telecommunications industry to adopt cooperative standard-setting by these organizations as the sole method to achieve standardization. Currently, the International Telecommunications Organization and the International Organization for Standardization are the two principal cooperative standardization organizations in the telecommunications industry.

Executive-Branch Rulemaking And Dispute Settlement In The World Trade Organization: A Proposal To Increase Public Participation, Aubry D. Smith

Michigan Law Review

This Note argues that, because the Executive Branch increasingly will be promulgating domestic regulatory rules intended to comply with the rules of the world-trading system, it is necessary to increase formal oversight of the Executive Branch's role in that context. Part I argues that the United States' participation in the WTO implies a substantial increase in the impact of foreign policy on domestic policy. Part II points out a loophole in Congress's attempt to compensate for this increase by installing various devices to ensure political oversight of the Executive: the Executive Branch is subject, under the Uruguay Round Agreements Act …

Trade, Competition, And Intellectual Property--Trips And Its Antitrust Counterparts, Eleanor M. Fox

Vanderbilt Journal of Transnational Law

This Article examines the interface between TRIPS' protection of intellectual property rights and antitrust law, and the extent to which TRIPS invites a counterpart agreement that would internationalize intellectual property antitrust rules.

Professor Fox argues that TRIPS does not call for internationalizing antitrust law, and that even developing countries, which might find a greater need for antitrust protection against abuse of dominance after TRIPS, might be better served by developing and enforcing a national antitrust law of their own.

She argues that TRIPS does, however, contemplate some limits to antitrust, lest antitrust enforcement impair protections guaranteed by TRIPS. Professor Fox …

The Beginnings Of The Rule Of Law In The International Trade System Despite U.S. Constitutional Constraints, Yong K. Kim

This study focuses on the emergence of ROL in U.S. international trade policy, a development which merits closer examination for the following reasons. First, the United States must still be considered the leader in international trade policy, and a ROL order without the most important trading entity would make little sense. Second, the United States is probably the foremost proponent of instituting a ROL order in international trade, though, ironically, it may also be the prime culprit in adhering to certain power-ordered relationships. Part II then outlines the facts in the dispute and gives a brief introduction to the decisions at the Panel and Appellate Body stages. Only after four years of prenegotiations did the Uruguay Round of Multilateral Trade Negotiations take place in 1986. This paper analyzes the prenegotiation phase on international trade in services by focusing on a North-South perspective of the underlying economics of international trade in services and the diplomatic exercise this prenegotiation phase set off. The factors during the prenegotiation phase which led to the launch of the Uruguay Round of negotiations are dissected as well as how the prenegotiation phase weakened the GATT’s long standing positive reputation.
