A New And Old Theory For Adjudicating Standardized Contracts, Eric Mills Holmes, Dagmar Thurmann Dec 1987

A New And Old Theory For Adjudicating Standardized Contracts, Eric Mills Holmes, Dagmar Thurmann

Scholarly Works

The purpose of this article is rather simple, extracting a new theory of standard form contracts from the good bits of the spectrum of "old" ideas and combining them with some fresh rethinking. For something fresh, the authors choose to examine the German law on standard form contracts. The authors have tried to remain neutral observers but in extracting the best from the spectrum of ideas one necessarily states--in this instance, one of pragmatic compromise. Thus, this article will cull and identify elements from the spectrum specifically concerning standard form contracts and compare them with the German approach. This process …

A Recommended Approach To Bail In International Extradition Cases, Jeffrey A. Hall Dec 1987

A Recommended Approach To Bail In International Extradition Cases, Jeffrey A. Hall

Michigan Law Review

This Note proposes such a consistent approach, arguing that courts in international extradition cases should focus on the accused's risk of flight rather than on the presence or absence of specific "special circumstances." Part I briefly discusses the international extradition process and outlines the important societal and individual interests at stake in the bail decision. Part II discusses the origin and evolution of the judicial approaches to bail in international extradition cases and demonstrates the inconsistency in the lower courts' treatment. Part III suggests an approach for making bail decisions in international extradition cases. It argues that the determinative factor …

International Law And The Grotian Heritage, L C. Green Sep 1987

International Law And The Grotian Heritage, L C. Green

Dalhousie Law Journal

Recent emphasis on codification of this or that aspect of international law has encouraged a number of writers to re-examine the "classics" with a view to ascertaining the extent to which we have moved from the 17th and 18th centuries and how far the views of the "teachers" are still relevant or may even today be regarded as lexferenda. Coincident with the fourth centenary of the birth of Grotius, the Interuniversitair Instituut voor International Recht T.M.C. Asser Instituut in cooperation with the Grotiana Foundation organized a commemorative colloquium in the Peace Palace and the Academy of International Law at the …

An Analysis Of The Law Of The Sea And Outer Space Law : Claims Over The Natural Resources Of The "Commons", Robin Elizabeth Lewis May 1987

An Analysis Of The Law Of The Sea And Outer Space Law : Claims Over The Natural Resources Of The "Commons", Robin Elizabeth Lewis

Master's Theses

As new areas of the world and outer space have been discovered and explored, man has had to develop regulations to govern the use of these new areas. However, it was not until man possessed the technological means of extracting or using the resources of these new areas that there was an urgent need to develop regulations for the oceans and space. Although some regulations have been established in regards to such areas as the deep sea-bed and remote sensing, there is still a need for the international community's acceptance of these laws. Under-developed nations view the resources discovered within …

Racism In Great Britain: Drawing The Line On Free Speech, Kenneth Lasson Apr 1987

Racism In Great Britain: Drawing The Line On Free Speech, Kenneth Lasson

All Faculty Scholarship

On any given Sunday in Hyde Park, London's huge urban sanctuary of tailored ponds and manicured gardens, one is likely to hear outrageous and provocative public utterances about race and religion. A few of those venting their spleen here are practicing rhetoricians, a few are clearly acting-but others are absolutely sincere in their hatemongering and passionate in their vilification. All of them are focal points for assembled spectators of varying classes, many of whom are professional hecklers. The police, milling about to put down possible disturbances of the peace, are seldom called upon to quell roused rabble. Thus is this …
