Based on the general contention that International Law can (and has) served imperialist purposes – that is to say, extend a nation’s authority over another by establishing an effective influence on its political and economic affairs –, this paper intends to illustrate how the 1846 Friendship, Commerce and Navigation Treaty concluded between the United States and Colombia – commonly known as the Mallarino-Bidlack Treaty –was eventually used by the former as a neocolonial device on the latter. This paper intends to explore the relation between foreign investment and forced Migration in the context of Colombian armed conflict. Through the illustration of recent cases, it shows the various forms in which the operation of multinational corporations has generated adverse effects to the vulnerable communities located at their area of influence, thus generating processes of involuntary human mobility. In that way, it is established that there is a symbiotic relation between conflict and development, affecting the structure and scope of the norms for both the protection of forced migrants and accountability for human rights violations. Considering the intention of introducing a dialogue on the possible interconnections between Foreign Investment Law and Corporate Governance, the purpose of this paper is to present some ideas on the International Investment Agreements likelihood to make Corporate Social Responsibility compromises more robust by including specific provisions on the matter. More specifically, it is intended to understand the ways on which Investment Law –and more specifically International Investment Agreements– influences the structure and dynamics of Corporate Governance, so as to assess whether the inclusion of Corporate Social Responsibility on the abovementioned legal instruments might influence the conduct of Multinational Corporations.

This Study addresses the question on whether the migratory phenomenon –considering with special attention the admission of non-nationals– might be regulated under the framework of regional integration processes, using the case of South America as an instance proclive to show how international law can be complemented and adapted to a specific context. This article seeks to illustrate how the United Nation´s Security Council is entailing a sort of hegemonic capability to act as a legislator, having as a premise the absence of such figure under international law, provided the apparent structure and dynamics of the Law of Nations. This article seeks to illustrate how the Principles of Distinction and Proportionality, coming from a branch of primary rules (International Humanitarian Law) have a relevant influence on the modern system of international criminal responsibility, consecrated in the Statute of the International Criminal Court, ICC. It is found that even if the latter contains provisions –war crimes– reproaching conducts due to their indiscriminate character, there are gaps related with the meaning and extension of such criminal conducts; this problematic is explained on one hand, by the political reluctance of States to compromise their sovereignty, and the specificities of the punitive function …
