On The Language Of Social Rights And New Modes Of Governance, Philippe Reyniers Jan 2007

On The Language Of Social Rights And New Modes Of Governance, Philippe Reyniers

Philippe Reyniers

The paper addresses the danger of two abstractions. The first is the indeterminacy of the language of fundamental social rights. The second is the abstract description of social policies within the Open Methods of Coordination. I then evaluate the possibilities of founding Social Europe on the real experience of injustice.

La Vidéosurveillance Sous L'Angle De La Proportionnalité : Premières Réflexions Au Sujet De La Loi Réglant L'Installation Et L'Utilisation De Caméras De Surveillance, Franck Dumortier Jan 2007

La Vidéosurveillance Sous L'Angle De La Proportionnalité : Premières Réflexions Au Sujet De La Loi Réglant L'Installation Et L'Utilisation De Caméras De Surveillance, Franck Dumortier

Franck Dumortier

Using Internet 'Borders' To Coerce Or Punish, Benjamin E. Brockman-Hawe Jan 2007

Using Internet 'Borders' To Coerce Or Punish, Benjamin E. Brockman-Hawe

Benjamin E. Brockman-Hawe

The prevailing ideology of the 1990’s reflected widespread dissatisfaction with the inadequacy and negative humanitarian consequences of broad multilateral economic sanctions.3 This in turn provoked a search on the part of NGO’s, states, UN agencies and academic institutions for an alternative sanctions approach that would remove the significant burden traditional economic sanctions placed on vulnerable segments of society while accomplishing the objectives for which they were imposed. The result of these cooperative efforts - the conceptualization and implementation of “smart” sanctions over the next decade - reformed the multilateral sanctions regime in fundamental ways. The agencies and procedures collectively instituted …

Corégulation Et Responsabilité Sociale Des Entreprises, Gregory Lewkowicz, Ludovic Hennebel Jan 2007

Corégulation Et Responsabilité Sociale Des Entreprises, Gregory Lewkowicz, Ludovic Hennebel

Gregory Lewkowicz

This paper analyses the evolution of corporate social responsibility from an empirical and a theoretical point of view. After having described the framework of a theory of coregulation, the authors scrutinize the main regulatory instruments used in the context of corporate social responsibility. They demonstrate that the evolution of corporate social responsaibility delineates a new regulatory logic peculiar to a globalizing legal world. The paper concludes stating that this logic could be a paradigm for the study of an emerging global law.

What Is Distinctive About Terrorism And Anti-Terrorism Law?, Matthew S. R. Palmer Jan 2007

What Is Distinctive About Terrorism And Anti-Terrorism Law?, Matthew S. R. Palmer

The Hon Justice Matthew Palmer

Criminal offending and terrorist offending are similar in quality – the acts which constitute such offending are similar, and should be subject to similar levels of protection of civil and political rights. This is how a democracy should respond to domestic terror threats. To the extent that we are particularly concerned about the motivation of terrorists in challenging the very maintenance of public order by a state, we should reflect that concern in the penalties we impose on such proven offending, not in giving in to the temptation of lower burdens of proof of the existence of the offending or …

A People Betrayed-The Darfur Crisis And International Law: Rethinking Westphalian Sovereignty In The 21st Century, Jackson N. Maogoto, Kithure Kindiki Jan 2007

A People Betrayed-The Darfur Crisis And International Law: Rethinking Westphalian Sovereignty In The 21st Century, Jackson N. Maogoto, Kithure Kindiki

Jackson Nyamuya Maogoto

This Article uses the Darfur Crisis in Sudan as a case study. It argues that rather than eliminating sovereignty as a political ideology, a more productive enterprise would be to refocus the discourse away from the traditional structural understanding of the term, which only serves to accentuate the level of discrepancy between the theological and the political definitions of the term and which ultimately leaves the false impression that absolute sovereignty is somehow realizable in the international political sphere. This refocus would constitute a shift toward a functional conception of sovereignty, wherein the purpose that State sovereignty would serve in …

The Final Frontier: The Laws Of Armed Conflict And Space Warfare, Jackson N. Maogoto, Steven Freeland Jan 2007

The Final Frontier: The Laws Of Armed Conflict And Space Warfare, Jackson N. Maogoto, Steven Freeland

Jackson Nyamuya Maogoto

This article focuses on the application of the current laws of war to the emerging phenomenon of space weaponization and the increasing likelihood in the next few decades of space becoming a battleground. This predicament requires new ways of thinking and legal regulation, considering that the existing principles of the Laws of Armed Conflict (LOAC) are primarily focused on air, land and terrestrial warfare. This article addresses the special problems arising from applying the LOAC to space warfare. It will also analyze the significant problems posed by space assets dedicated to uses of both a civilian and military nature – …

Law Enforcement Responses To Trafficking In Persons: Challenges And Emerging Good Practice, Fiona M. David Ms Jan 2007

Law Enforcement Responses To Trafficking In Persons: Challenges And Emerging Good Practice, Fiona M. David Ms

Fiona David

In recent years, the Australian Government has committed significant resources to combating trafficking in persons. Within this larger anti-trafficking effort, the community sector, law enforcement, prosecutors, health professionals and members of the community all have an important role to play. As each sector comes to terms with the reality of trafficking in Australia, it is important that emerging challenges and possible solutions are identified. This paper focuses on the challenges that may confront law enforcement officials in any country in their efforts to detect trafficking, identify victims, investigate offences and contribute to the successful prosecution of offenders. Drawing on international …

Science Or Security: The Future Of The Free Flow Of Scientific Information In The Age Of Terror, Geoff Holland Jan 2007

Science Or Security: The Future Of The Free Flow Of Scientific Information In The Age Of Terror, Geoff Holland

Geoff Holland

Politically or ideologically motivated speech has been the primary focus of much of the recent political, legal, and academic debate on restrictions on speech imposed as a reaction to perceived threats to national and international security. However, restrictions imposed on informing speech as a response to the threat of terrorism raise equally serious concerns. The development of the body of knowledge relies on the free flow of information, including persuasive speech. Since the terrorist attacks of September 11 and the subsequent anthrax attacks in the US, the issue of censorship of scientific information has been subject of debate in both …

Tribal, State, And Federal Cooperation To Achieve Good Governance, Prof. Elizabeth Burleson Jan 2007

Tribal, State, And Federal Cooperation To Achieve Good Governance, Prof. Elizabeth Burleson

Prof. Elizabeth Burleson

Jurisdictional uncertainty affects tribal sovereignty and public safety. Management of natural resources remains one of the few realms of authority over which tribes have retained control. Ancient wild rice harvesting by the Chippewa provides a context in which to consider a tribes ability to set water standards, as does Pueblo ceremonial use of the Rio Grande River. Cooperative tribal, state, federal, and international responses to the Methamphetamine crisis can address both environmental and human health. This study examines the prospect for integrated protection of health and habitat based upon comity and cooperation. It examines the parameters of homeland security and …

Climate is a public good requiring the development of an energy strategy based upon international cooperation, energy efficiency, and sustainable technological development.

Rethinking The Procreative Right, Carter Dillard Jan 2007

Rethinking The Procreative Right, Carter Dillard

Carter Dillard

Few principles are as universally accepted in legal scholarship today, but based on such scant support, as the fundamental nature and broad scope of the right to procreate. What is perceived as a vague but nonetheless justified legal and moral interest to procreate freely without regard to others is, upon closer examination, based on little more than misconstrued or inapposite case precedent and blurry statements in non-binding sources of international law. By relying on this authority, conflating procreation with conceptually distinguishable behaviors, presuming its intrinsic value, and ignoring competing rights and duties, lawyers have largely overlooked procreation and its legal …
