Accelerating The Gains Of The Free Maternity Care In Kenya's Urban Informal Settlements, Juliet K. Nyamao
William & Mary Journal of Race, Gender, and Social Justice
The 2010 Constitution of Kenya recognizes the special group of women living in urban informal settlements, and provides for their access to the highest attainable standards of health care, including reproductive health care. The Health Act, which was enacted in 2017, recognizes the significant challenges of accessing maternal health services among the poorest populations. Pursuant to the resolutions of the African Union, the Health Act abolished user fees for pregnant women. The Health Act instructs the county and national governments to expand free maternity care and childhood immunizations through funding. The Kenya 2007 December presidential election results were violently challenged. For months, political protests accompanied by violent attacks and violent reaction by government security forces, led to “ethnic cleansing” particularly in the Rift Valley region resulting in deaths of more than 1,500 people and internal displacement of about 450,000 others. Women and young girls experienced various forms of gender violence during and after the conflicts in internally displaced persons (IDP) camps. Using in-depth interviews with women living in a camp, NGOs and government agencies, this article focuses on the continuing bodily violence that internally displaced women face in their everyday …

The Prohibition Of Widespread Rape As A Jus Cogens, Dean Adams

This Comment explains why the prohibition of widespread rape should be recognized as a jus cogens through analyses of the failure of existing international legal instruments, advances within international law towards the universal prohibition of widespread rape, and policy reasons for classifying widespread rape as a jus cogens. In doing so, this comment will demonstrate the particular timeliness of this topic by reviewing the use of widespread rape in several countries through the 1990s, the widespread rape presently occurring in Kenya, and the emerging reports from Iraq of rape committed at the hands of the Saddam Hussein regime.
