The March To Copenhagen And The Quest For Climate Justice, Ondotimi Songi, Timipere Songi
Ondotimi Songi
Following events preceding the Copenhagen conference on climate change, the article looks at whether world leaders can seal a comprehensive, fair, effective and binding climate change deal. It traces efforts at addressing climate change from a policy and legal perspective noting that the discussion on climate change has focused on environmental and economic costs and suggesting that the issue be seen from a human rights and development perspective so as to realign strategies and programmes on mitigation and adaptation. From an African perspective, as a continent that is worst hit by climate change, it is noted that apart from insisting …

The casenote criticises the "essentialist" approach of the European Court of justice in the definition of a collective right to consultation in the phase of restructuring. It defends a "functionalist" approach, where collective labour rights are individual rights exercised collectively.

Conciliación Entre Derecho Al Trabajo Y Libertad De Trabajo Desde La Perspectiva De Los Derechos Sociales,Económicos Y Culturales, Sebastián A. Pizarro
Sebastián A. Pizarro

The Legal And Practical Aspects Of Atm's In Tanzania, Daudi Mwita Nyamaka Mr.
Daudi Mwita Nyamaka Mr.
The concern of our study was to examine the legal and practical aspects of ATMs in Tanzania. The major problems that were being examined are; the 24 hours operation on ATMs vis-à-vis system failure or error and the system of one bank allowing cardholders of another bank to use its ATMs. With the first problem, all banks in Tanzania with ATMs have attractive advertisements to customers that affirm sufficient services in any time of the day but in reality, the machines usually fail to respond the instructions of the cardholder regardless the fact that the cardholder inserts the card and …

Caméras De Surveillance : La Cohabitation Légale Reste Houleuse…, Franck Dumortier
Franck Dumortier

Law Enforcement Cooperation In Anti-Trafficking Cases, Anne T. Gallagher, Paul Holmes
Anne T Gallagher
Gallagher and Holmes consider the extent to which cross-border cooperation between national law enforcement agencies is necessary for an effective criminal justice response to trafficking. In exploring the opportunities and challenges of such cooperation, the presenters draw on first-hand experience of working with the ASEAN Heads of Specialist Trafficking Units Process ; established in 2004 to promote exchange of intelligence and good practices between specialist trafficking units in South East Asia.

The Nigerian Social Health Insurance System And The Challenges Of Access To Health Care: An Antidote Or A White Elephant?, Obiajulu Nnamuchi
Obiajulu Nnamuchi
This paper is an excursion into the operation of the recently launched National Health Insurance Scheme of Nigeria. Its primary task is to determine whether social health insurance in Nigeria, as expressed in the statute establishing the scheme, has prospects for actualizing its promise of, inter alia, ensuring access to affordable health care for every Nigerian. To make this determination, the paper critically analyzes key components of the scheme, focusing on the different actors and issues, the interplay of which is crucial to the scheme's successful implementation. Regrettably, the depth and breadth of the analysis are somewhat constrained by the …
The Interpretation Of European Union Law And The Dislocation Of The Patterns Of European Social Legitimacy, Philippe Reyniers
The Interpretation Of European Union Law And The Dislocation Of The Patterns Of European Social Legitimacy, Philippe Reyniers
Philippe Reyniers
The present paper first defends that the interpretation of European Union law is not an operation that concerns the relationship between a legal norm and a judge, but also the inter- institutional relationship of the judicial and other political legitimacies. It then goes on to analyse the development of new modes of governance as a form of de-judicialisation and an “exit” from regulation by law. It finishes by analysing the Laval case as an example of deference the Court of justice and the European legislator, conceived in an outdated institutional setting. It concludes that the recuperation of legitimacy (“voice”) developed …

Etat Des Droits De L'Homme En Matière De Fichage Et De Respect Du Droit À La Vie Privée, Franck Dumortier
Franck Dumortier

According to International Labour Organization (ILO) statistics, more than 70 percent of all child laborers work in agriculture. From tending cattle, harvesting crops, to handling machinery or holding flags to guide planes spraying pesticides, more than 132 million girls and boys, aged 5 to 14, help produce much of the food and drink people consume, as well as fibers and primary agricultural materials. ILO also notes that, of course, the numbers vary from country to country but it is estimated that at least 90 percent of economically active children in rural areas in developing countries are working in agriculture. However, …

History And Evolution Of International Cultural Heritage Law: Through The Question Of The Removal And Return Of Cultural Objects, Ana Filipa Vrdoljak
Ana Filipa Vrdoljak
The role of law in the removal and return of cultural objects has long been fraught and contested. This paper examines the history and development of the legal protection of cultural heritage at the international level with particular reference to the return of cultural objects.
With a view to facilitating the Intergovernmental Committee's future work, the paper is divided into four parts. First, there is an examination of the historical development of international cultural heritage law in respect of restitution over the last two centuries. Second, the establishment and work of the Intergovernmental Committee is considered in this historical legal …

Human Rights And Genocide: The Work Of Lauterpacht And Lemkin In Modern International Law, Part I, Ana Filipa Vrdoljak
Ana Filipa Vrdoljak
2008 marked the sixtieth anniversary of the adoption of the Genocide Convention and Universal Declaration of Human Rights by the UN General Assembly. These two instruments adopted and proclaimed by then newly formed world body on successive days, 9 and 10 December 1948 respectively, represent two sides of one coin. Born of the horrors of the 1930s and 40s, the United Nations Charter speaks of human rights and to the importance of the rule of law. The Genocide Convention and UDHR are integral to the pursuit of these aims.
The work of two international lawyers, Hersch Lauterpacht and Raphael Lemkin, …
