La preocupación por el fenómeno de la trata de personas en el escenario internacional ha sido una constante para los Estados desde mediados del siglo XIX. En Colombia la legislación que condena el delito empezó su recorrido desde el Código Penal de 1980, en donde se castigaba con penas de prisión de 2 a 6 años a todo aquel que promoviere la entrada o salida del país de mujer o menor de edad para ejercer la prostitución. Following events preceding the Copenhagen conference on climate change, the article looks at whether world leaders can seal a comprehensive, fair, effective and binding climate change deal. It traces efforts at addressing climate change from a policy and legal perspective noting that the discussion on climate change has focused on environmental and economic costs and suggesting that the issue be seen from a human rights and development perspective so as to realign strategies and programmes on mitigation and adaptation. This paper is an excursion into the operation of the recently launched National Health Insurance Scheme of Nigeria. Its primary task is to determine whether social health insurance in Nigeria, as expressed in the statute establishing the scheme, has prospects for actualizing its promise of, inter alia, ensuring access to affordable health care for every Nigerian. The present paper first defends that the interpretation of European Union law is not an operation that concerns the relationship between a legal norm and a judge, but also the inter- institutional relationship of the judicial and other political legitimacies. It then goes on to analyse the development of new modes of governance as a form of de-judicialisation and an “exit” from regulation by law. According to International Labour Organization (ILO) statistics, more than 70 percent of all child laborers work in agriculture. From tending cattle, harvesting crops, to handling machinery or holding flags to guide planes spraying pesticides, more than 132 million girls and boys, aged 5 to 14, help produce much of the food and drink people consume, as well as fibers and primary agricultural materials. ILO also notes that, of course, the numbers vary from country to country but it is estimated that at least 90 percent of economically active children in rural areas in developing countries are working in agriculture. 2008 marked the sixtieth anniversary of the adoption of the Genocide Convention and Universal Declaration of Human Rights by the UN General Assembly. These two instruments adopted and proclaimed by then newly formed world body on successive days, 9 and 10 December 1948 respectively, represent two sides of one coin. Born of the horrors of the 1930s and 40s, the United Nations Charter speaks of human rights and to the importance of the rule of law. The Genocide Convention and UDHR are integral to the pursuit of these aims.

This is a brief on the merits authored by my co-counsel, Smita Rao, and I to the Inter-American Court of Human Rights in the case of Lysias Fleury v. Haiti (Case No. 12.459). This case was recommended to the Inter-American Court by the Inter-American Commission on Human Rights.
