The Plight Of Kenyan Domestic Workers In Gulf Countries, Caroline Muthoni Gikuru
The Plight Of Kenyan Domestic Workers In Gulf Countries, Caroline Muthoni Gikuru
Master's Theses
Kenya’s economy remains the regional leader within the East African Community (EAC) and among East African countries at large. However, political instability such as the 2007 post-election violence and the region’s social and political instability trickling into Kenya, have negatively affected the country’s economic growth. To bridge the economic gap, Kenyan women are seeking employment in the domestic service sector in the Gulf Countries, with Saudi Arabia being the most popular destination. At their destination countries, some domestic workers are subjected to various forms of abuse by their employers, leaving the worker without recourse due to the lack of legal …

Una Lucha Contra La Corriente: Análisis De La Ley 779 Ley Integral Contra La Violencia Hacia Las Mujeres En Nicaragua, Christina Brown
Independent Study Project (ISP) Collection
Fashion, Sexism, And The United States Federal Judiciary, Charles E. Colman
Fashion, Sexism, And The United States Federal Judiciary, Charles E. Colman
Charles E. Colman
The U.S. federal judiciary has frequently displayed a dismissive attitude toward "fashion," while simultaneously recognizing the great economic importance of clothing. As fashion was, from the formation of the United States until at least the late 1960s, associated primarily with the female sex, while judges during this time period were almost exclusively male, one naturally wonders whether the power dynamics of gender shaped the development of the law pertaining to fashion. There is good reason to believe that this has indeed been the case.

We are having the inevitable late night conversation. You talk about your eventual wedding, your marriage to the person you love, the timeline you’ve created for yourself, and your plans for what our future children will do together. I clarify that I don’t want to have children, but you can’t seem to understand that decision. You question how happy, satisfied, or fulfilled my life will be without children, the maternal instincts I’m supposed to be feeling, and my desire to have something to care for and love. You’re convinced that I will recognize how empty my life will be sans …

Love In Action: Noting Similarities Between Lynching Then & Anti-Lgbt Violence Now, Koritha Mitchell
Koritha Mitchell
The more I learn about the violence currently plaguing LGBT communities, the more it reminds me of the brutal practice of lynching, which has been the focus my research for the past 15 years. Ultimately, both forms of violence are designed to deny targeted groups recognition as citizens. Relying on my expertise regarding racial violence as well as the data on anti-LGBT attacks collected by the National Coalition of Anti-Violence Programs (NCAVP), this essay notes similarities between lynching at the last turn of the century and anti-LGBT violence today. The piece identifies five parallels: 1) the mundane quality of the …

Hero With A Thousand Copyright Violations: Modern Myth And An Argument For Universally Transformative Fan Fiction, Natalie H. Montano
Northwestern Journal of Technology and Intellectual Property
Copyright law is designed to protect the ownership and financial rights of the original author of a literary work. However, the internet has created new opportunities for amateur writers to create their own fan fiction based on such literary works. Borrowing from the ideas and characters of a work, fan fiction authors build upon and re-imagine these stories. Such fan works should be protected under the Fair Use Defense, but the power imbalance between amateur fan fiction authors and successful published authors often leads to the eradication of fan stories from the public domain.
This Comment argues that fan fiction …

Fair Trade An Analysis Of The Effects On Poverty Alleviation And Empowerment For Women In Developing Countries, Maribel Concepcion Lora
Fair Trade An Analysis Of The Effects On Poverty Alleviation And Empowerment For Women In Developing Countries, Maribel Concepcion Lora
Graduate Program in International Studies Theses & Dissertations
This thesis approaches the economic development model of Fair Trade with a critical analysis on determining its success in alleviating poverty and empowering women of the developing world. Because international labor regulations are not consistently enforced in all producer countries, the Fair Trade model has established labor standards that ensure above all, a fair wage and safe working conditions for producers participating in the international market. As a recent strategy of economic development, Fair Trade has made great strides to empower poor producers in impoverished countries; however there has been limited analysis focused on its impact for improving the quality …

State of the Urban Youth India 2012: Employment, Livelihoods, Skills Executive Summary Every third person in urban India is a youth. In less than a decade from now, India, with a median age of 29 years will be the youngest nation in the world. India’s demographic transformation is creating an opportunity for the demographic burden of the past to be converted to a dividend for the future. For this to happen the country needs to adopt a three-pronged policy that will address the issues of employment, livelihoods and the skill status of youth. The State of the Urban Youth India …
“Queering The Rainbow Nation”: An Analysis Of 11 Gay And Lesbian Capetonians’ Perceptions Of Lgbt Identity In Cape Town And The South African Government’S Commitment To Lgbt Equality, Ryan Sasse
Independent Study Project (ISP) Collection
The South African government has made vast strides in the fight for LGBT equality, strides that are unparalleled by any other nation on the African continent. Unfortunately, the lack of hate crime legislation within the country—as well as the government’s unwillingness to address the nation’s resulting violence—often overshadows the accomplishments that have been made over the last few years. Keeping in mind that “[f]eminist research goals foster empowerment and emancipation for women and other marginalized groups, and feminist researchers often apply their findings in the service of promoting social justice for women,” we can see how the LGBT community is …

Marriageable Age In Islam: A Study On Marriageable Age Laws And Reforms In Islamic Law, Jeremiah J. Bowden
Marriageable Age In Islam: A Study On Marriageable Age Laws And Reforms In Islamic Law, Jeremiah J. Bowden
LUX: A Journal of Transdisciplinary Writing and Research from Claremont Graduate University
One area of Islamic law that has been subject to much criticism as of late is the practice of child-marriage. Some, preferring to view Islam suspiciously, tend to create a caricature of Muslims as morally depraved individuals who force young daughters into marriages to old men for financial gain. Several polemicists commenting on this practice have hurled virulent epithets toward the Prophet Muhammad, whom they believe to be the originator of this abhorrent practice. After exploring instances where child-marriage still occurs, I will examine how this practice is currently being reformed in a way consistent with Islamic law. Ultimately, I …

Assimilation, Acculturation, And The Law: Solving A “Problem” Like Shar’Ia, Kristina E. Benson
LUX: A Journal of Transdisciplinary Writing and Research from Claremont Graduate University
An unexpected development in the English legal system involves Muslim women’s use of legally binding Shar’ia councils to protect their autonomy, marital security, and property rights. Although scholars and political commentators alike have voiced concerns that Muslim women will be treated unfairly in these councils, there is some indication that women have become adept at navigating this plural legal landscape and that they have often managed to secure better outcomes from Shar’ia family law than from English courts. Over 80 Shar’ia tribunals have been established to issue legally binding decisions on divorce, child custody, inheritance, and other areas of family …

It is important to understand the context in which gender budgeting has acquired great attention in the Union Budget 2013-14. India’s record for achieving the Millennium Development Goals has been extremely poor as compared to several African, Latin American and Asian Counties. In international for a “Shining India” India has been named and shamed continuously for not being able to reduce maternal mortality rate and child mortality rate, wide spread anaemia and malnutrition among women and children, starvation deaths in certain pockets, sky rocketing prices of essential goods for the poor, namely food, water and cooking fuel.

The Right To Freedom Of Expression And Media Reporting On Criminal Proceedings In Tanzania: Finding The Balance, Joseph Wawa Raphael Futakamba S

This paper examines the impact of media reporting to crime and criminal court proceeding in Tanzania in the light of exercising the legitimate right to freedom of expression by the press, on one hand and the accused rights to presumption of innocence and fair trial on the other hand. The purpose of the discussion revolves around the effect of prejudicial crime reporting to the criminal suspects/accused and available remedies within the legal system. It also, looks upon the court practices and the law in dealing with interference with the course of justice. The paper also analyses the rights of the …

One hot summer's day in the late 1950s, a young mother put her three young children down for a nap. She also bathed and prepared four of her sister's children for naptime. This young woman had volunteered to care for her nephew and nieces while their mother, her younger sister, was in the hospital delivering her fifth child. A short while after putting all of the children in their beds, the children's father, her brother-in-law, knocked on the door. The young woman assumed that he had come over to see his children and to bring them news of their mother …
Third Wave Feminism's Unhappy Marriage Of Poststructuralism And Intersectionality Theory, Susan Archer Mann
Third Wave Feminism's Unhappy Marriage Of Poststructuralism And Intersectionality Theory, Susan Archer Mann
Journal of Feminist Scholarship
This article first traces the history of unhappy marriages of disparate theoretical perspectives in US feminism. In recent decades, US third-wave authors have arranged their own unhappy marriage in that their major publications reflect an attempt to wed poststructuralism with intersectionality theory. Although the standpoint epistemology of intersectionality theory shares some common ground with the epistemology of poststructuralism, their epistemological assumptions conflict on a number of important dimensions. This contested terrain has generated serious debates within the third wave and between second- and thirdwave feminists. The form, content, and political implications of their "unhappy marriage" are the subject of this …

Why Women's Leadership Is The Cause Of Our Time, Rangita De Silva De Alwis
All Faculty Scholarship
Women continue to be underrepresented in leadership positions throughout the world. Yet, studies show that the exclusion of women from politics and public service negatively impacts the public good. Identifying women's leadership as the economic and moral imperative of our time, this Article explores the way in which greater representation of women in leadership positions yields beneficial results for both women and men, as well as social and economic progress. By examining the reasons for the substantial barriers women face in obtaining such positions, including the masculinization of politics, gendered caregiving responsibilities, and gender violence, this Article concludes that unless …

(Re)Pinning Our Hopes On Social Media: Pinterest And Women's Discursive Strategies, Katherine Gantz
Journal of Feminist Scholarship
Pinterest, the theme-based image-sharing website, has seen a predominantly female usership since its launch in 2010. Unique in both its design and its demographics in the US, the site has generated distinctive patterns of use, posing new questions about how women are claiming this particular spot in social media as their own. Supported by both feminist linguistic and social science research, this article undertakes a discussion of Pinterest's implicit and explicit gendered protocols of usership, which result in what I argue is an emerging women's online rhetoric. Through the examination of images and accompanying comments taken from the site, I …
What's Feminism Got To Do With It? Examination Of Feminism In Women's Everyday Lives, Claire Carter
What's Feminism Got To Do With It? Examination Of Feminism In Women's Everyday Lives, Claire Carter
Journal of Feminist Scholarship
In recent decades there has been considerable debate about the role and meaning of feminism in younger women's lives. Feminism can be understood as an empowering discourse, fostering critical awareness and resistance to dominant social norms. However, it can also be experienced as regulatory and disciplinary, clearly defining who and what constitutes a "good" feminist. Utilizing Michel Foucault's principle of care of the self, this paper analyzes women's body practices in relation both to women's interpretation of feminism and to dominant feminist discourses. The complexities of negotiating diverse social identities, as well as women's desire for a happier life and …

Was That Ethical? Feminist Critics’ Response To The “Queerness” Of Modernist Women’S Writing, Meridith M. Kruse
Journal of Feminist Scholarship
This article employs insights from contemporary theories of ethical reading to conduct a case study of feminist critics’ reaction to the queerness of modernist women’s writing. My aim is to develop a set of practices and principles for ethically responding to queerness in literary texts and everyday life, as well as contribute feminist acumen to the current claim that the humanities are the best site to train students how to do justice to texts. The introduction utilizes theories of ethical reading set forth by Jane Gallop and Eve Kosofsky Sedgwick to develop a preliminary framework of ethical response. The subsequent …
