The book is divided into 3 parts – marriage, matrimonial remedies and property / economic rights of women. It explains 18 judgments in a simple language, each a landmark on an issue, and also contains a brief analysis of the impact and usefulness of the judgment for furthering women’s rights.

Access To Community Healthcare For Youth In The Juvenile Justice System: Initial Lessons From The Massachusetts Health Passport Project, Francine Sherman

From 2004-2010, the author directed the Massachusetts Health Passport Project (MHPP), aimed at facilitating continuous access to healthcare for girls and boys in the juvenile justice system in two Massachusetts counties. This article describes the health challenges facing youth, and particularly girls in the juvenile justice system including the significant barriers to health care access that these youth face. It goes on to describe the Massachusetts Health Passport Project, designed to: 1. Improve access to healthcare; 2) Change relevant systems; 3) Improve youth’s social supports; and 4) Improve youth’s health status. The article draws on an evaluation of MHPP to …

De un tiempo a esta parte, los tribunales civiles de Lima vienen concediendo resarcimientos a ciegas, sobre la base del artículo 345-A del Código Civil peruano, en el cual se obliga al magistrado, a "velar por la estabilidad del cónyuge perjudicado" en los casos de separación de hecho, ya señalando una "indemnización", ya ordenando la "adjudicación preferente de bienes de la sociedad conyugal".
En este comentario de jurisprudencia se explica por qué es equivocado asociar la "indemnización" referida en dicha norma con la responsabilidad civil, y se brindan elementos para su correcto enfoque como importante manifestación de la solidaridad familiar.

Supporting Children, Balancing Lives, Katharine K. Baker

This paper examines how U.S. child support policy validates traditional divisions of labor and thereby hinders individual attempts to achieve an acceptable work/family balance. It argues that by using the household as the relevant unit of measurement for child support purposes, family law doctrine legitimates the specialization contracts that arise within households. These specialization contracts, used most extensively in wealthy, elite households, undermine attempts to distribute caretaking and provider roles more equally between parents. The article suggest that by dispensing with the household as the relevant unit of measurement and treating all parents individually, each with a responsibility to caretake …

This book chapter tells the story of the contempt case brought against Elizabeth Morgan, a Washington, D.C., doctor imprisoned for her failure to produce her daughter for extended visitation with the ex-husband she accused of sexual abuse. The chapter sets the stage for the proceeding in terms of the shift in custody law in the mid-eighties from the maternal presumption to a preference for shared parenting and the discovery of and almost immediate backlash against allegations of childhood sexual abuse. O presente artigo visa a discutir e demonstrar a forma historicamente paternalista com que o ordenamento pátrio trata seus cidadãos, ilustrando a tese por meio do tratamento jurídico dado aos maiores de 60 anos que, a despeito de serem absolutamente capazes, não têm direito a escolher o regime patrimonial de eventual união conjugal, devendo adotar, obrigatoriamente, o de separação total, sob os argumentos de proteção aos idosos contra golpistas e da expectativa de herança da família anterior.
