Summary Judgment For Divorce Required When One Spouse Swears To Irretrievable Breakdown, Kenneth R. Carswell

In Manning v. Manning, the Supreme Court of Georgia held that a divorce must be granted on a motion for summary judgment after one spouse alleges an irretrievable breakdown of the marriage and then swears in an affidavit that he is unwilling to cohabit with his spouse, that there are no prospects for reconciliation and that the marriage is irretrievably broken. There is, at that point, no issue of fact for the trial court to resolve, the supreme court said.

Domestic relations cases continue to bombard the appellate courts. Approximately 100 such decisions were reviewed for the survey, but only a handful was truly significant. Perhaps the most important of these are the cases attempting to construe Georgia's new "no-fault" ground for divorce.' The subject matter of this report has been sub-divided for ease of use into six substantive areas: marriage, divorce, custody, alimony, adoption (including change of name), and legislation.

Child Support Enforcement And Establishment Of Paternity As Tools Of Welfare Reform—Social Services Amendments Of 1974, Pt. B, 42 U.S.C. §§ 651-60 (Supp. V, 1975), Judith B. Stouder

Washington Law Review

This note will discuss the purposes of' the amendrnents, describe how the provisions are intended to, work, and indicate what is required by HEW and the state welfare agencies for compliance. Constitutional and administrative problems that can be anticipated as the provisions are implemented will also be explored. Finally, the existing Washington State system of child support enforcement will be explained and offered as an example of a successful approach to this difficult problem.

After the type for this article had been set, the US. Supreme Court decided two cases having potential implications for the constitutional rights of minors-Bellotti v. Baird, 44 US. L. W. 5221 (July 1, 1976) and Planned Parenthood of Central Missouri v. Danforth, 44 U.S.L. W. 5197 (July 1, 1976). In Belloti, a unanimous Court held that the lower federal court should have abstained from determining the constitutionality of a state statute requiring parental consent to an unmarried minor's abortion but providing for judicial order of consent "for good cause shown" after parental consent is refused. The economic settlement accompanying a marriage dissolution may consist of one or both of the following: (1) the initial "property settlement," sometimes referred to as a "division" of property when only community property is involved; and (2) provisions for maintenance payments categorized as alimony, child support, or some combination thereof. The tax problems of property settlements have been analyzed previously by the author. They are considered here only to the extent necessary to distinguish property settlements paid in installments from periodic maintenance payments made for the support of a former spouse, or for children of the marriage, or both. The power and force of a name are often underestimated in today's society. For centuries, social and political struggles have often been reflected in struggles over names and the naming process. Names have often been used as a means of insuring allegiance and fealty, as when King John required conquered Welsh insurgents to adopt names identifying them as King John's subjects. In the early 1900's, the resentment against immigrants resulted in strong pleas to prevent them from adopting more common names which disguised their immigrant ancestry. Do divorced fathers under orders of child support pay? We have found a large county in Michigan where most fathers pay most of the time.

Each Michigan county contains an unusual agency that oversees nearly all matters relating to divorce. Known as the Friend of the Court, the agency advises the circuit judges on child custody and the appropriate amount of support orders in all divorce cases in which there are children.
