The legal issues inherent in treating out-plant pollution under the Taft-Hartley Act cannot be fully evaluated without a realistic appreciation of practical considerations and industrial experience. For this reason, considerable empirical information has been collected from a variety of sources. The examination and evaluation of this data will precede the legal analysis. The data, it is hoped, will resolve two questions: What is the effect of out-plant pollution on the workers, and what has been the response of labor unions to date?

Substance And Procedure In The Construction Of The National Environmental Policy Act, Lloyd A. Fox
University of Michigan Journal of Law Reform
In 1969 Congress enacted the National Environmental Policy Act (NEPA or Act) in an effort to deal with the many environmental problems facing the United States. In the three years that the Act has been in force, a large number of suits has been filed by environmental organizations seeking to enforce the standards enunciated in NEPA. The courts hearing these cases generally agree that NEPA imposes only procedural duties on administrative agencies. This implies that the courts will merely determine whether the agency in question has complied with the procedural requirements contained in Section 102 of the Act. This further …

The most useful aquatic areas in the world are in serious danger of destruction. The estuaries, where fresh water, land and sea meet in a dynamic and highly productive zone, are today gravely threatened through unwise and unplanned excessive use of their valuable but finite capacities. Estuaries include the coastal zone which is affected by both the run-off of fresh water from the land and the salt water from the sea. This zone includes tidal rivers, marshes, bays and river mouths. The value of these estuarine regions has been well established by biologists. However, this value is fully appreciated by …
