Hell Hath No Fury Like A Fan Scorned: State Regulation Of Sports Agents, Phillip J. Closius

This article first describes the existing system of state statutes regulating sports agents, including the proposed Model Uniform Athlete Agents Act. The article then examines the validity of these statutes in the context of jurisdictional limitations and dormant Commerce Clause principles. Lastly, federal regulation and the rules of professional sports unions are considered as alternatives to state legislative activity.

This article is, in its most general sense, a critique of the idea of autonomy which is common to the understanding of both law and music. The idea of the autonomy of law, as an enterprise with its own rules and its own conventions, is parallel to a view of the composer working alone, uninfluenced by what has gone before, creating masterpieces free of cultural contexts. This year's report concentrates on recent legal developments concerning regulation of the location of "adult entertainment businesses." Such regulations raise serious constitutional issues because the First Amendment's guarantee of freedom of expression extends to non-obscene sexually oriented media. The U.S. Supreme Court, however, has established that local government may single out adult businesses for special regulatory treatment in the form of locational restrictions if the local government can show a substantial public interest in regulating such businesses unrelated to the suppression of speech and if the regulations allow for "reasonable alternative avenues of communication," which essentially translates into a reasonable …
