The human race has evolved, grown and expanded through the exploration of Earth. After initial steps on the Moon, our next challenge is to explore the solar system. Mars shows potential for both scientific discovery and future human settlement, and so is a prime candidate for the next leap of human exploration. Such a bold endeavor will be a driver for an unprecedented worldwide cooperative effort and the catalyst for a new era of international, intercultural and interdisciplinary human relations. Commercial human spaceflight presents an area for engaging novel human activity and objectives, to include space exploration, entertainment, transportation and extraterrestrial resource acquisition. The inherent dangers and lack of scientific and medical certainty involved however raise interrelated questions of ethics, bioethics, law and public policy. This is particularly the case with spaceflight participant (SFP) screening, selection, and commercial human spaceflight activities where regulations are currently silent or lacking. Inventing Around Edison’S Lamp Patent: The Role Of Patents In Stimulating Downstream Development And Competition, Ron D. Katznelson, John Howells

We provide the first detailed empirical study of inventing around patent claims. The enforcement of Edison’s incandescent lamp patent in 1891-1894 stimulated a surge of patenting. Most of these later patents disclosed inventions around the Edison patent. Some of these patents introduced important new technology in their own right and became prior art for new fields, indicating that invention around patents contributes to dynamic efficiency. Contrary to widespread contemporary understanding, the Edison lamp patent did not suppress technological advance in electric lighting. The market position of General Electric (“GE”), the Edison patent-owner, weakened through the period of this patent’s enforcement.

Abstract: Most aspects of construction projects mainly fall under contractual regime. However, when things go wrong such as when the project is abandoned for various reasons, they may create two different scenarios: a contract that is breached and a fixed structure that is left on the land which may constitute an incomplete benefit that is acquired by one of the parties. The transfer of such benefit is initially made with a legal ground, but that ground has since ceased to exist. In the first part of this article – frictions – we elaborate on the shift from hierarchical to lateral, networked structures in various fields. Specifically, we address the fields of software, content, design, electronics, manufacturing, and services. In all these fields we find various types of frictions between new structures and approaches and traditional ways of working with intellectual assets. Since the release of the 2004 and 2008 reports of the congressionally-authorized Commission to Assess the Threat to the United States from Electromagnetic Pulse Attack (“EMP Commission”), there has been a growing societal realization that civilian infrastructure is vulnerable to electromagnetic pulse (EMP) threats. This paper provides an overview of work to define a set of standards for adoption by the academic high altitude balloon community. These standards go above-and-beyond the requirements imposed by §101 of the Federal Aviation Regulations, incorporating best practices and suggesting how §101 requirements should be interpreted and applied in several situations.
One area where FAR§101 is extremely vague is with regards to the operations of balloons with small payloads. These payloads are exempt from most requirements; however, they are required to not create a “hazard”. Problematically, what exactly qualifies as a “hazard” is not defined in FAR§101 or elsewhere …

The small satellite space certainly falls within the realm of ITAR considerations. Some programs operate under the (perhaps mistaken) belief that ITAR doesn’t apply to them (or that they will never be caught). Others may assert that they are working under the basic research exemption. Still others have implemented ITAR information and facility access controls. At best, ITAR introduces a level of uncertainty regarding small satellite programs; at worst, it may be a predator lurking in the proverbial ‘tall grass’ waiting to pounce.
