Paramount clause acts as a referral clause or reference to a certain set of standards, and achieved that in maritime transport, the charterer is subject to the mandatory regime of responsibilities established in the agreement to bring the clause. However, it must be noted that the grade you receive this clause may be varied, so is can be seen as the rule of autonomy of the parties, or as alleged incorporation by reference or even as a possible standard required application.

This article contributes to the long stalled debate about the arbitrability of disputes between publicly-held companies, their shareholders and directors, one of the last, zealously guarded bastions of judicial competence. A crucial difference between this and prior commentary is that the subject is not viewed in a vacuum: significant developments, both domestic and international, signal radical changes in the perception of the legal and policy implications of intra-public company arbitration.

The note makes the statement that the Family Courts of Cyprus have been gradually transformed, from tribunal to court, since their establishment in 1990, by means of the legislative reforms and the evolution of case law in the past two decades. Having been launched as tribunals, in replacement of the ecclesiastical jurisdiction over divorce cases of the Greek Orthodox Community, they presently stand as superior courts of limited jurisdiction (courts of justice), with power and specialization over all matters of family law. The Movement Toward Early Case Handling In Courts And Private Dispute Resolution, John Lande

This article identifies early case handling (ECH) as an important general phenomenon in dispute system design theory and practice, catalogs the major ECH processes, and urges practitioners and policymakers to encourage use of and experimentation with ECH processes when appropriate. The key element of ECH is that people intentionally exercise responsibility for handling the case from the outset. ECH processes in courts include early case management procedures, differentiated case management systems, early neutral evaluation, and other early alternative dispute resolution (ADR) processes.
