Since the beginning of the formation of the constitution for an independent Indonesia by the founders of the state, the state government system adopted is a presidential system. After the amendment to the 1945 Constitution, the perpetrators of the changes, namely the Peoples Consultative Assembly (MPR) wanted to emphasize that the 1945 Constitution of the Republic of Indonesia adhered to a pure presidential system by upholding the supremacy of the constitution, so that the executive as government administrator was responsible to the constitution. Ever since the U.S.’ 2003 invasion, Iraq’s legal system has been mired by corruption, sectarianism, and deceit. In an effort to allay the negative effects of these things, each iteration of the Iraqi government since 2003 has doubled down on efforts to appear legitimate within the eyes of the public. Government-funded propaganda, secret police, intense censorship, and even campaigns of torture and kidnapping by security forces are just some of the ways in which the government has sought to gain legitimacy. This article is devoted to the importance of improvement of the prosecutor’s powers in court proceedings at the time of ongoing judicial and legal reforms, prosecutor’s participation in court proceedings as a state representative generally supporting public accusation, as well as the impact of his knowledge, behavior, readiness for the trial, involvement in the examination of evidence and perceptions on the decision making stage, regarding the case.
