Australian journalist Paul Sheehan's representation of the alleged and convicted immigrant Muslim/Arab rapists he demonises in Girls Like You, like his representation of the rape survivors in that text, has much to tell us about the law's production of rape law's speaking and signifying subjects, "real rape" victims and survivors, false accusers and perpetrators. Probation Sentencing Of Convicted Child Sex Offenders, Robert Marsh, Steven Patrick

This research examines the probation sentencing of convicted from data collected over an 8 year period. The research uses multiple regression and nominal log linear regression to examine length of probation and whether or not the convicted offender is actually sent to prison or sent to probation. While many independent variables appear to be related to probation sentencing and whether one is actually sent to prison or probation, they fall into three categories; characteristics of the victim, characteristics of the offender and characteristics of the crime.

Sexualbrottens sexualitet(er) - om den straffrättsliga konstruktionen av sexualitet

Under de senaste trettio åren har sexualbrottslagstiftningen varit föremål för omfattande kritik, särskilt utifrån feministiska argument. Dessa argument, bestående i att sexuellt våld betraktas som ett uttryck för bristande jämställdhet mellan könen, har tagits upp i flera statliga utredningar. I första hand har utformningen av våldtäktsparagrafen diskuterats och ifrågasatts. Dock har förekomsten av en särskild brottskategori benämnd sexualbrott inte utmanats nämnvärt. Genom att ta avstamp i den enkla frågan ”Vad är ett sexualbrott?” syftar mitt avhandlingsprojekt till att utforska den straffrättsliga konstruktionen av sexualitet.

Exceptional Justice: A Discourse Ethical Contribution To The Immigrant Question, David Ingram

I argue that the exception must be a legitimate possibility within law as a revolutionary project, in much the same way that civil disobedience is. In this sense, the exception is not outside law if by "law" we mean not positive law as defined by extant legal documents (statutes, legislative committee reports, written judgments, etc.) but law as a living tradition consisting of both abstract norms and a concrete historical understanding of them.
