Class Actions In Canada: The Promise And Reality Of Access To Justice, Camille Cameron

Class actions have found their way into the fabric of Canada’s civil justice system. Class action legislation has been in place in Ontario for 27 years and in British Columbia and Quebec for 25 and 40 years respectively. Trial and appellate courts have had many opportunities to deal with and develop the law of class actions. Notwithstanding their longevity, however, there is little qualitative and empirical research to test many of the justice claims that are made in favour of, and the criticisms that are levelled at, class actions. A Review Of When Legal Orders Collide: The Role Of Courts By Sabino Cassese, Kathleen Claussen

Indiana Journal of Global Legal Studies

The growth and interaction of legal orders beyond the state has precipitated considerable interest among scholars and practitioners. The resulting discussion both in the academy and in the upper reaches of government about the intersection of national legal orders with new areas of non-national law has led to various predictions about possible ramifications of this phenomenon. In recent years, the importance of these transnational questions has grown concurrently with the expansive creation and heightened activity of supranational and global organizations.' Book Review Of Power Without Law: The Supreme Court Of Canada, The Marshall Decisions, And The Failure Of Judicial Activism By Alex M Cameron, Dianne Pothier

Alex Cameron’s book, Power Without Law, is a scathing critique of the Supreme Court of Canada’s 1999 decisions in R. v. Marshall upholding Donald Marshall Jr.’s Mi’kmaq treaty claim. Cameron’s book has attracted a lot of attention because of the author’s position as Crown counsel for the government of Nova Scotia. Cameron was not involved as a lawyer in the Marshall case itself. As a fisheries prosecution, Marshall was a matter of federal jurisdiction pursuant to s. 91(12) of the Constitution Act, 1867, 3 and Nova Scotia chose not to intervene.
