Virtual life sentences are sentences with a term of years that exceed an individual’s natural life expectancy. This exploratory study is one of the first to collect data that establish the existence, prevalence, and scope of virtual life sentences in state prisons in the United States. Initial data reveal that more than 31,000 people in 26 states are serving virtual life sentences for violent and nonviolent offenses, and suggest racial disparities in the distribution of these sentences. This study also presents potential policy implications and suggestions for future research.

Next to Texas, no state has executed more capital defendants than Virginia. Moreover, the likelihood of a death sentence actually being carried out is greater in Virginia than it is elsewhere, while the length of time between the imposition of a death sentence and its actual execution is shorter. Most of the public agrees that society is safer without psychopaths.
However, a new sentencing strategy for psychopaths facing the death
penalty has erupted from both mental health researchers and defense
lawyers-imploring juries to view a defendant's psychopathy as a
consideration of sentencing mitigation, and, consequently, urging juries to
impose life imprisonment instead of the death penalty.

This article explains the frightening nature of psychopaths, how
neuroscience and neuroimaging intersects with the study of psychopathy,
and, specifically, whether an fiMRI brain scan is appropriate mitigating
evidence in death penalty sentencing hearings when the convicted
defendant is a diagnosed psychopath.
