Dealing With Dirty Deeds: Matching Nemo Dat Preferences With Property Law Pragmatism, Donald J. Kochan

Donald J. Kochan

An organizing principle of the rule of law based on individualism and order is expressed by the Latin maxim nemo dat quod non habet – roughly translated to mean that one can only give what they have or one can only transfer what they own.  Yet when title disputes arise between two or more purchasers, we have accepted pragmatically that exceptions must be made to nemo dat and that, at times, we may have to, in essence, validate fraud and other dirty deeds.  The Article outlines the basic place of the nemo dat principle in our system of law, introduces …

La Prevención Y Represión De Los Fraudes Alimentarios En La Unión Europea, Luis González Vaqué

Luis González Vaqué

Food fraud, or the act of defrauding buyers of food or ingredients for economic gain has vexed the food industry throughout history. Despite the integrity of the majority of the food industry and their commitment to consumer protection and consumer confidence, the issue of food fraud has gained attention in recent times. Although EU food law is very detailed with respect to food safety (including controls and tests in areas such as residues and other contaminants of food and feed), there is no framework in place specifically to target food fraud, other than the general stipulation that consumers may not …

The Jurisprudence Of Nature: The Importance Of Defining What Is "Natural", Jill M. Fraley Sep 2015

The Jurisprudence Of Nature: The Importance Of Defining What Is "Natural", Jill M. Fraley

Jill M. Fraley

Informal regulations defining nature, natural, and organic have proliferated across diverse fields of law from patents to agriculture, from taxation to gemstones. The unwritten jurisprudence of defining nature is primarily a story of the struggle to isolate mankind’s manipulations and interventions, creating a man-nature dichotomy that frustrates more than it explicates. This failure to define nature continues with the Supreme Court’s recent Myriad decision, which struggles to define the law of nature exception to patentability, highlighting the challenge of measuring levels of human intervention and manipulation. Our dichotomous definitions do not generate neat, binary answers, but rather complicated scales of …

The Price Of Trust: An Examination Of Fiduciary Duty And The Lender-Borrower Relationship, 29 Wake Forest L. Rev. 719 (1994), Cecil J. Hunt Ii Aug 2015

The Price Of Trust: An Examination Of Fiduciary Duty And The Lender-Borrower Relationship, 29 Wake Forest L. Rev. 719 (1994), Cecil J. Hunt Ii

Cecil J. Hunt II

Comparing the search for elements which will give rise to a fiduciary relationship between a bank and a borrower to the quest for the elusive holy grail, Professor Hunt proposes that, rather than existing only in special circumstances, the fiduciary relationship is a normal aspect of the bank-borrower relationship. Hunt explains that a fiduciary obligation is part of the parties' assumptive base in the bank-borrower relationship that must by necessity exist before any borrower would entrust private or business information to a bank in return for a loan. While acknowledging that such a relationship might be inapposite in the initial …

Nutritional Labelling In France - Causes And Implications Of Consumer Confusion, Luis González Vaqué

Luis González Vaqué

This article discusses the controversial and heavily debated initiatives aimed at introducing nutritional labelling in France – initiatives which have exploited the ambiguity of the Art. 35 of the Regulation (EU ) No 1169/2011 on the provision of food information to consumers and have also perhaps misappropriated the provisions of Art. 34.

Payment Methods For Consumer-To-Consumer Online Transactions, David E. Sorkin Jul 2015

Payment Methods For Consumer-To-Consumer Online Transactions, David E. Sorkin

David E. Sorkin

Participants in online auctions use a variety of payment mechanisms, but checks and money orders still represent the most commonly used means of payment. Credit cards afford greater protection to buyers, but until recently payment by credit card was not even an option for person-to-person transactions. However, several online payment services have been established that enable individuals to make credit card payments to one another, generally with the payment service acting as an intermediary. These services are growing rapidly, mainly because of the speed and convenience that they offer. Yet relatively little attention has been paid to the risks and …

El Insostenible Desperdicio De Alimentos: ¿Qué Podemos Hacer Los Consumidores?, Luis González Vaqué Jun 2015

El Insostenible Desperdicio De Alimentos: ¿Qué Podemos Hacer Los Consumidores?, Luis González Vaqué

Luis González Vaqué

Abstract: All of us - farmers and fishers; food processors and supermarkets; local and national governments; individual consumers - must make changes at every link of the human food chain to prevent food wastage from happening in the first place, and re-use or recycle it when we can't. We simply cannot allow one-third of all the food we produce to go to waste or be lost because of inappropriate practices, when 870 million people go hungry every day. On consumer side, raising awareness of the problem - and how to prevent it - is very important. Better communication among all …

Information To Consumers On The Absence Or Reduced Presence Of Gluten In Food: Commission Implementing Regulation (Eu) No 828/2014 / July 17, 2015, Luis González Vaqué

Luis González Vaqué

On 30 July 2014, the European Commission adopted Commission Implementing Regulation (EU) No 828/2014 of 30 July 2014 on the requirements for the provision of information to consumers on the absence or reduced presence of gluten in food.

In this article, renowned food lawyer Mr. Luis González Vaqué seeks to analyse what is new in this Community legislation. To do so he first look briefly at Commission Regulation (EC) No 41/2009 of 20 January 2009 concerning the composition and labelling of foodstuffs suitable for people intolerant to gluten, especially because Implementing Regulation No. 828/2014 will only enter into force on …

Businesses Are People Too? Anomalies In Widening The Ambits Of "Consumer" Under Consumer Credit Law, Francina Cantatore, Brenda Marshall Jun 2015

Businesses Are People Too? Anomalies In Widening The Ambits Of "Consumer" Under Consumer Credit Law, Francina Cantatore, Brenda Marshall

Brenda Marshall

This article examines the position of the small business as "consumer" under existing consumer protection legislation and the incongruities arising from this characterisation in the area of consumer credit regulation. While the inclusion of small businesses may be defensible under the Australian Consumer Law, it is contended that this is not the case in consumer credit regulation. It is arguable that such an inclusion impacts significantly on commercial dealings and could have a lasting effect on the availability of credit to small businesses. The effects of treating businesses as consumers in relation to consumer credit transactions are far-reaching, potentially affecting …

A Statutory Override Of An "As Is" Sale: An Historical Appraisal And Analysis Of The Ucc, Magnuson-Moss, And State Lemon Laws, Richard J. Hunter Jr.

Richard J Hunter Jr.

ABSTRACT This article considers the common law view that a sale of a used car is essentially “as is,” in light of state “lemon laws” which attempt to protect the interests of used car buyers under certain circumstances. The article focuses on major provisions of the New Jersey “lemon law” which provide for specific vehicle and parts coverage, length of warranty protections, and buyer rights in case the automobile is deemed to be a “lemon,” as potential areas of concentration for further state-specific legislation. The article describes the essence of a traditional “as is” sale, and highlights the fact that …
