Purpose: This paper aims to examine the risks associated with smart contracts, a disruptive financial technology (FinTech) innovation, and assesses how in the future they could threaten the integrity of the global financial system. Design/methodology/approach: A qualitative approach is used to identify risk factors related to the use of new financial innovations, by examining how over-the-counter (OTC) derivatives contributed to the Global Financial Crisis (GFC) which occurred during 2007 and 2008. Evidence is the key to solve any crime. Evidence integrity needs to be protected in order to make it admissible in the court of law. Digital evidence is more revealing, but it is fragile; it can easily be tampered with or modified. There are different techniques available to protect the integrity of digital evidence. Different automated digital evidence acquisition tools are available in the market. In this paper, we have analyzed two automated tools (EnCase and FTK Imager) that are used for disk imaging. In this contribution I argue that the image of the balance is often used to defend the idea of a trade-off. To understand the drawbacks of this line of thought I will explore the relationship between online security technologies and fundamental rights, notably privacy, non-discrimination, freedom of speech and due process.
