An Overview Of The Broadband Market In Thailand, Tanit Follett

Thailand’s telecommunications sector is not fully transformed from monopolistic telecommunications markets into competitive one. The establishment of National Telecommunications Commission (“NTC”), an independent telecommunications regulatory agency, in 2004 has brought about the goal of creating a level-playing competition among incumbents: state enterprises, concessionaires, and new entrants. However, it becomes more challenging for NTC to achieve that goal when the concession agreement still exists. This fundamental problem has a direct impact on residential broadband Internet access as its system architecture relies heavily on fixed-line telecommunications network. Both licensed and unlicensed spectrum has certain advantages over the other. However, licensed approach should not be looked upon as a substitute for unlicensed approach as each serves a different market need based on tradeoffs among the cost, quality of service, and time to market. The availability of both approaches allows providers and emerging market to fulfill a variety of usage needs. The Standard Setting Organization of IP rules has a confused mixture of legal theories that lead to the problem of disclosure. Each of the SSO IP rules has its own pitfalls. In general, considering all rules together, these legal rules share the same common goal in ensuring that participating IP owners do what they promised to do and disclose what they are bound to disclose.
