The significance and timeliness of Michael Mello’s book was brought home to me recently when I participated in a conference on same-sex marriage at Brigham Young University Law School in Provo, Utah. Nearly everyone in the audience opposed permitting two men or two women to marry each other. Many favored an amendment to the United States Constitution to prevent any state from permitting same-sex couples to marry. In this country, during the last decades of the twentieth century, thousands of lesbians married other women and thousands of gay men married other men. Many of these couples recited traditional vows in churches and synagogues. Others have pledged to each other in their own backyards in words that they wrote themselves. But not one of these thousands of solemn occasions was recognized as creating a legally valid marriage. Over these thirty years, lesbians and gay men have increasingly challenged conventional definitions of marriage and the family. In this brief article, we tell the story of gay people and family law in the United States across this period. We divide our discussion into two sections: issues regarding the recognition of the same-sex couple relationship and issues regarding gay men and lesbians as parents. These issues overlap, of course, but since family law discussions commonly treat adult-adult issues of all sorts separately from parent-child issues, we believe it convenient and helpful to do so as well.
