Though the freedom of establishment has its roots in the provisions of the Treaty of Rome, it is the work of the Court of Justice of the European Union (the Court) that has been instrumental in the evolution of this freedom. In a succession of cases, the Court has transformed this otherwise largely theoretical concept into a functional tool responsive to the needs of business.
