This thesis studied the history of the school of sharīʿa judges (1907-1927) as an essential episode of the reform of Sharīʿa courts in Egypt in the early 20th century. The thesis studied the school in connection with the broader context of legal modernization of the Egyptian legal system. The study explored the institutional, pedagogical, and legal aspects of the reform that the school advocated. The study analyzed the impact of the school’s pedagogy on the practice of the Islamic judiciary and the theoretical conception of Sharīʿa. Refugee Community-Based Organizations (CBOs) have emerged as a natural response from the communities themselves to bridge the gap between the state and NGOs and the refugee community. However, CBOs in Egypt face challenges that impact their operation and continuity. Through qualitative research, this study aims to explore the experience of the Yemeni CBOs. The purpose of this thesis was to study the lawsuit case of the of Nanticoke Lenni-Lenape Tribal Nation V. John J. Hoffman and to showcase how modern-day racism ultimately led to their federal lawsuit in 2015. Racism and racist biases over Indian gaming has affected not just the Nanticoke Lenni-Lenape tribe, but tribes all over the country and has severely hindered tribes in the state and federal acknowledgment process. The project discusses the effects of Haiti’s colonization as the space transitions from Hispaniola to Saint-Domingue and later to the free state of Haiti. This is done by studying the concept of the right to conquest and the absurdities that exist around the first appearances of international law. The Sharīʿa codification, privatization and reconciliation present three reform movements to scientize Sharīʿa in the manner of liberal positivism. The scientism of Sharīʿa makes Islamic law predictable, rational and objective. Its final goal is to protect Sharīʿa from the political encroachments of the ruling elites and facilitate Sharīʿa implementation in a post-colonial era. The three reform movements are, however, incapable of harmonizing Sharīʿa with the liberal norms of a scientized law. Sharīʿa codification makes the law predictable but neglects Sharīʿa’s undemocratic methods of decision-making. The dominant approach to addressing violence against women in Egypt today is carceral, or relying on the punitive instruments of the state to achieve justice (most visibly represented by the prison and police). While carceral responses are perhaps unsurprisingly advocated by state feminism, they are also promoted by what would typically be described as anti-state actors. This thesis advances the study of the legal literature from the madhhab-law tradition by way of studying the Shāfiʿī literary tradition and its two most authoritative classics. These two works are al-Nawawī’s (d. 676/1278) digest Minhāj al-ṭālibīn and Ibn Ḥajar al-Haytamī’s (d. 974/1567) commentary on it, Tuḥfat al-minhāj. This study will provide a typology of the development of the Shāfiʿī juristic texts. The typology is based on an indigenous and coherent periodization centered around an analysis of the intellectual and social developments within the Shāfiʿī legal tradition, not the classical Eurocentric periodization scheme. Writing for the majority, Justice Kennedy opined that not extending marriage equality to same-sex couples violated both their autonomy and their right to equal dignity under the law. In this dissertation, I propose to better explain the argumentative processes by which communities are constituted in political crisis moments and how, within those moments, social movement and legal rhetorics co-create the rhetorical possibilities for queer legal worldmaking. Specifically, I argue that affect functions as an important tool within argumentative loci of presence (magnitude, proximity, and severity) and is intimately connected to value-warrants in political argument.
