Fcc Regulation Versus Antitrust: How Net Neutrality Is Defining The Boundaries, Babette E.L. Boliek Oct 2012

Fcc Regulation Versus Antitrust: How Net Neutrality Is Defining The Boundaries, Babette E.L. Boliek

Babette Boliek

This Article challenges the various jurisdictional theories that underpin the FCC’s net neutrality regulation. The assertion of jurisdiction by the FCC over any aspect of the Internet ecosystem has raised populist, congressional, and even judicial rhetoric to a crescendo and resulted in a recent vote to defund the FCC’s efforts. This Article places the current crisis squarely in the context of the long-standing jurisdictional struggle between regulation and antitrust law. These two regimes are often at jurisdictional cross-purposes because, even though they both purport to maximize the social good, they do so by inapposite means. Indeed, there is a policy …

Towards An Empirical And Theoretical Assessment Of Private Antitrust Enforcement, Joshua Davis, Robert Lande Dec 2011

Towards An Empirical And Theoretical Assessment Of Private Antitrust Enforcement, Joshua Davis, Robert Lande

Joshua P. Davis

The dominant view in the antitrust field is that private enforcement cases, and especially class actions, accomplish little or nothing positive but, on the contrary, are counterproductive. Despite strongly worded convictions, that view has been premised on anecdotal, self-serving and insufficiently substantiated claims. Indeed, the authors' 2008 study of 40 private cases appears to constitute the only systematic effort to gather information about a significant number of private antitrust actions. That study generated a great deal of controversy, including questioning of our conclusions by high officials at the Department of Justice and by Professor Daniel Crane at the University of …

Net Neutrality And Nondiscrimination Norms In Telecommunications, Daniel Lyons Dec 2011

Net Neutrality And Nondiscrimination Norms In Telecommunications, Daniel Lyons

Daniel Lyons

“Net neutrality” refers to the principle that broadband providers should not discriminate when transporting content and applications over the Internet. After several years of debate, the Federal Communications Commission adopted binding net neutrality rules in December 2010. The cornerstone of this regime is a binding rule that forbids broadband providers from unreasonably discriminating when delivering Internet traffic. The prohibition on unreasonable discrimination has a long pedigree in telecommunications law, and net neutrality proponents have long asserted the need to extend that nondiscrimination norm to cyberspace. But the Commission’s net neutrality rules impose far greater obligations on broadband providers than the law …

Digital Platforms In A Competition Law Context. A New Function Of Competition Law In The Digital Era, Vincenzo Franceschelli Dec 2011

Digital Platforms In A Competition Law Context. A New Function Of Competition Law In The Digital Era, Vincenzo Franceschelli

Vincenzo Franceschelli

In a classical approach, competition law is a combination (or, if you prefer, a blend or a mixture) of law and economics. The ultimate traditional accepted goal of antitrust is to increase competition and consequently to protect the consumer.

In the digital era, competition law is going beyond its original objective of creating and preserving a competitive market.

Monopoly or dominant position in the digital world effects the communication system, and therefore citizen’s fundamental rights.

Freedom of expression, the right to be informed, privacy, access to information and to the net are preserved in a competitive and pluralistic market and …

The Extraordinary Deterrence Of Private Antitrust Enforcement: A Reply To Werden, Hammond, And Barnett, Joshua Davis, Robert Lande Dec 2011

The Extraordinary Deterrence Of Private Antitrust Enforcement: A Reply To Werden, Hammond, And Barnett, Joshua Davis, Robert Lande

Joshua P. Davis

Our article, "Comparative Deterrence from Private Enforcement and Criminal Enforcement of the U.S. Antitrust Laws," 2011 B.Y.U. L. Rev. 315, documented an extraordinary but usually overlooked fact: private antitrust enforcement deters a significant amount of anticompetitive conduct. Indeed, the article showed that private enforcement "probably" deters even more anticompetitive conduct than the almost universally admired anti-cartel enforcement program of the United States Department of Justice. In a recent issue of Antitrust Bulletin, Gregory J. Werden, Scott D. Hammond, and Belinda A. Barnett challenged our analysis. They asserted that our comparison “is more misleading than informative.” It is unsurprising that they …

Winner Or Loser? A Post-Quota Case Study Of Pakistan's Textiles And Clothing Exports, Umair H. Ghori Dec 2011

Winner Or Loser? A Post-Quota Case Study Of Pakistan's Textiles And Clothing Exports, Umair H. Ghori

Umair H. Ghori

Textiles and Clothing (T&C) is a critically important sector of international trade for developing countries and least developed countries (LDCs). The T&C sector engages abundant labour resources and requires low investment threshold. The T&C sector has been a contentious area in multilateral trade negotiations. With the expiration of quotas in 2005, many T&C dependent countries are experiencing considerable adjustment challenges. Pakistan is one such country that is extensively reliant on T&C industries. This research note presents a brief case study which looks at post-quota developments in Pakistan's T&C trade and the trade and economic policy issues it raises.

Unraveling The Chicago/Harvard Antitrust Double Helix: Applying Evolutionary Theory To Guard Competitors And Revive Antitrust Jury Trials, Thomas J. Horton Dec 2011

Unraveling The Chicago/Harvard Antitrust Double Helix: Applying Evolutionary Theory To Guard Competitors And Revive Antitrust Jury Trials, Thomas J. Horton

Thomas J. Horton

This paper addresses the Supreme Court's current favorable view of monopolies and strong antipathy toward antitrust jury trials. The current Chicago/Harvard philosophical antitrust double helix is built around the ideas that monopolies are generally efficient and procompetitive while juries are unable to grasp complex antitrust economics. Building upon evolutionary analyses in previous papers, this article recommends a new philosophical antitrust double helix that will generate increased enforcement of and compliance with the language and spirit of sections 2 of the Sherman Act and 7 of the Clayton Act. The article recommends that we reform the misappropriated and misapplied "protect competition, …
