Failures of long-term care (LTC) policies caused undesirable negative outcomes for Canadian long term care residents during the COVID-19 pandemic. The purpose of this study was to explore similarities and differences in LTC policies between Ontario (Canada, Ontario), China, and Japan and identify potentially beneficial ideas for policy improvement in all countries. An adapted framework for comparing health care systems guided data collection. Information about four major policy areas: regulation, service provision, PSW workforce, and financial policies was extracted from LTC policy documents, government reports, and research articles. This study's primary purpose is to critically appraise current federal and provincial policies regarding supervised consumption sites (SCS), noting intended and unintended consequences; and how these policies could impact SCS users. This study's secondary goal is to compare current policies related to SCS in Alberta, British Columbia, Ontario, and Quebec to provide critical insight and suggestions for ongoing policy development. Carol Bacchi’s (2009) “What is the Problem Represented to Be?” framework was applied to the Canadian policy document with a focus on SCS. Use of cannabis among adults 55 years of age and older is increasing. In Q4 of 2018, slightly over half of cannabis users used for therapeutic purposes at least once, where many reported using for both medical and non-medical reasons (mixed use). Research on older adults regarding the use of Cannabis for Therapeutic Purposes (CTP) is fragmented and there are no comprehensive or in-depth studies on their perceptions or self-reported motivations. This thesis examines the current state of the criminal law’s interaction with mentally ill persons, with a specific interest in this interaction during pre-trial phases such as arrest and bail. It argues that the current provisions in the Criminal Code of Canada that allow for limited instances of pre-trial mental health assessments for adults are insufficient. The current options, including assessments to determine “not criminally responsible for reasons of mental disorder” or “fitness”, are not applicable in many situations. On April 20, 2016, Health Minister Jane Philpott announced that legislation legalizing recreational marijuana would be introduced in Spring 2017, with the goal of keeping marijuana out of the hands of children and profit out of the hands of criminals. Bill C-45, An Act Respecting Cannabis passed the second reading in the House of Commons, and contains restrictions on advertising cannabis, with a few exceptions. Advertising is recognized as a protected form of expression under the Charter of Rights and Freedoms, so if the government infringes on this right, they must be able to prove that it is justified in …

Electronic Health Record Regulation In Canada: What The Patient Experience Reveals About The Pursuit Of Legislative Harmonization, Patricia M. Goodman

This thesis examines Canadian provincial and territorial personal data protection legislation as it relates to electronic health records (“EHRs”). The research categorizes Canadian jurisdictions’ approaches to EHR regulation and three models are identified. Using five criteria, the patient experience when interacting with each of the three models and a combination of the models is described, analyzed and reconciled. A fictional patient scenario is used as a tool to analyze patient interaction with the Canadian jurisdictions and the models. It is shown that, although Canadian jurisdictions use one of three separate modes of incorporating EHR-specific rules into legislation, the outcome of …
