Rhetoric—the arts of practical discourse that we broadly define as the use of symbols to influence belief and action—has something to say about contemporary legal theory and practice. Law and rhetoric in the West were born together nearly 2500 years ago in the Mediterranean. American law has eschewed its rhetorical roots since the late nineteenth century. Denying law’s rhetorical nature helps to construct an impartial façade, shoring up law’s legitimacy. Admitting the rhetorical nature of law would be to admit its partiality, or the point of view inevitably inscribed with every textual choice. At the same time, rhetorical theorists have …

Uniform Maine Citations is organized so that similar types of references to Maine authorities appear together. The organization is grouped by primary or secondary research materials, including subdivisions for (1) statutory and legislative materials, including constitutions, statutes, legislative documents, and municipal ordinances; (2) court decisions, rules, and documents; (3) executive agency regulations, reports, and other documents; and (4) secondary materials that analyze and interpret the primary materials, including Maine-specific treatises, practice books, and legal periodicals. The Perlmutter Center for Legal Justice at Cardozo Law announced it has expanded its team through the hiring of Benjamin Burger ’05 and Karena Rahall as Senior Staff Attorneys. The expansion of the team is a result of the $1M in funding the Perlmutter Center received from international law firm Milbank LLP earlier this year which also established the Milbank Exoneration and Resentencing Review Unit at the Perlmutter Center.

Cardozo welcomed its newest members of the JD and LL.M. community during orientation this week.
Approximately 260 students in the fall JD class began their law school journey. Many are native New Yorkers, while others traveled from other countries to study at Cardozo. About half have already worked in the legal field with various law firms or in different professional careers.

State Laws For Administering Presidential Elections: Recommendations And Considerations For Reform, Fordham Law School Rule Of Law Clinic, Seamus Crowley, Molly Johnston, Alexander Paget, William Russell

States have a critical role in administering presidential elections, and there are currently a range of emergent challenges that they must confront. In this report, the Fordham Law School Rule of Law Clinic outlines reform recommendations and considerations to assist states in crafting their presidential election administration policies in key areas, including (1) implementation of provisions of the federal Electoral Count Reform Act; (2) preparation for natural or human-caused election disruptions; (3) prevention of faithless and fake electors; (4) accommodation of third-party and independent candidates; and (5) preparation for implementation of the National Popular Vote Interstate Compact.

The authors analyze the conflict’s history, each side’s warfighting functions, the role of multidomain operations, and more. Eva Hanks, a pioneer in legal education and founding member of the Cardozo Law School faculty, died on Wednesday June 12th at the age of 95. Among other firsts, she was a founder in the field of environmental law and Cardozo’s first woman associate dean. During her 38-year tenure at Cardozo she taught Property, Torts and Elements of Law to generations of Cardozo students, before retiring in 2014.
