The Morality Of Trading And Purchasing Pollution Emissions Rights: Further Comments On The, Ibpp Editor

International Bulletin of Political Psychology

The December 12, 1997 Issue of IBPP provides an analysis supporting the trading and purchasing of pollution- emissions rights as means to responsibly confront the threat of global warming. The present article maintains this stance in critiquing a December 15, 1997 article in The New York Times by Michael J. Sandel, a professor of government at Harvard University.

Alarmist Decisions With Divergent Risk Information, W. Kip Viscusi

Receipt of multiple sources of risk information ideally should foster sounder decisions under uncertainty. This paper’s original survey results for environmental risks suggest that the learning process is reasonable in many respects, but it does not accord with a rational Bayesian learning model. Divergent risk assessments from different sources produce extreme violations of rationality, as there is inordinate weight on the high risk assessment. This alarmist reaction holds for both government and industry information sources. This phenomenon may account for the commonly observed phenomenon of public overreaction to highly publicized risks.

Franchisor Environmental Liability For Previously Contaminated Property, Patrick J. Kaufmann, William S. Vincent

Faculty Articles

Environmental legislation has created potential liability for retailing franchisees that purchase previously contaminated land. Faced with a decision to distance itself from the site selection process or incur the added costs and potential pricing impacts of greater involvement in the process, franchisors have strong incentives to reduce franchisee support. This reduction in support has detrimental implications for both franchise policy and environmental policy. A paper reports the results of an empirical study that links franchisors' concerns about potential environmental liability to actions to distance themselves from the site selection process or, alternatively, formally to require franchisee environmental investigation of all …

The Role Of Bilateralism In Fulfilling The Federal-Tribal Relationship: The Tribal Rights-Endangered Species Secretarial Order, Charles Wilkinson

Washington Law Review

On June 5, 1997, Secretary of the Interior Bruce Babbitt and Secretary of Commerce William Daley signed a jointly-released Secretarial Order entitled "American Indian Tribal Rights, Federal-Tribal Trust Responsibilities, and the Endangered Species Act"' The Order culminated a year-and-a-half of work by tribes and federal officials to craft an administrative system for resolving difficult questions involving tribal rights and the Endangered Species Act (ESA). The Order is important for the ESA's implementation. It also carries broader significance, for it serves as one major example of how the government-to-government relationship between the United States and Indian tribes can be successfully implemented.
