As independent state bodies, constitutional courts protect the Constitution by resolving constitutional disputes. As a result, they are often called "Guardians of the Constitution". The main activity of the constitutional courts is the control of the constitutionality of laws and other legal acts. In constitutional theory, there are such forms as: preliminary and subsequent constitutional control, which have their advantages and disadvantages. Therefore, this article highlights the framework of the establishment and development of the institute of Constitutional justice, and analyses the application of european and american models of constitutional control in Uzbekistan.

In this article, we focus on the nature of Islamic financial contracts and their features from the contracts which are available in the domestic legislation of Uzbekistan. Moreover, current article also examines how possible disputes could be solved in domestic courts based on the Uzbekistan’s choice of law as in many cases Islamic banks tend to put Sharia law as a choice of law in those contracts.

This article is a comprehensive examination of the U.S. practice of targeted killings. It is based in part on field research, interviews, and previously unexamined government documents. The article fills a gap in the literature, which to date lacks sustained scholarly analysis of the accountability mechanisms associated with the targeted killing process. The article makes two major contributions: 1) it provides the first qualitative empirical accounting of the targeted killing process, beginning with the creation of kill-lists extending through the execution of targeted strikes; 2) it provides a robust analytical framework for assessing the accountability mechanisms associated with those processes. …

Our research investigated four study jurisdictions: Arizona, Louisiana, Nevada, and Ohio. The data falls into two categories: analyses of reported appellate cases during designated periods in those jurisdictions; and investigations of the subsequent careers of every individual who resided on death row in one of our jurisdictions in April of 1995. The Dignity, Rights, And Responsibilities Of The Jury: On The Structure Of Normative Argument, Robert P. Burns

Many theorists follow an inevitably circular method in evaluating legal institutions and practices. "Considered judgments of justice" embedded in practices and institutions in which we have a high level of confidence can serve as partial evidence for the principles with which they are consistent, principles that can then have broader implications. Conversely, principles that we have good reason to embrace can serve as partial justification for institutions and practices with which they are consistent. This is the heart of Rawls' notion of "reflective equilibrium," where we "work at both ends" to justify institutions, practices, and principles. This method is applicable …

Tadić, The Anonymous Witness And The Sources Of International Procedural Law, Natasha A. Affolder

This article explores the Trial Chamber's decision to allow the use of anonymous testimony as a protective measure in the wake of the final judgment in the Tadić trial. This initial decision, granting the prosecutor's request for protective measures including the withholding of four witnesses' identities from the accused, formed a precedent upon which later rulings for protective measures relied, both throughout the Tadić case and in subsequent cases before the International Tribunal.
