Paris Agreement’s chief objective is to protect the Earth and its inhabitants from a point of no return, when the effects of climate change will be so intense that they will shift the equilibrium of ecosystems. The distinctiveness of this international environmental treaty is that it does not impose climate change mitigation measures, but rather allows nation states to create their own set of measures, the NDCs, to reach the global warming of ‘well below 2oC’ by the end of the century. Due to market failures that allow uncompensated negative externalities from burning fossil fuels, there has been a growing call for climate change-related litigation targeting polluting companies. To determine the most intensive carbon dioxide (CO₂)-emitting facilities in order prioritize liability for climate lawsuits, and risk mitigation strategies for identified companies as well as their insurers and investors, two methods are compared: (1) the conventional point-source method and (2) the proposed bottleneck method, which considers all emissions that a facility enables rather than only what it emits. The ability to harness energy is fundamental to economic and social development. Worldwide, almost 3 billion people have little or no access to beneficial energy resources for cooking, heating, water sanitation, illumination, transportation, or basic mechanical needs. Energy poverty exacerbates ill health and economic hardship, and reduces educational opportunities, particularly for women and children. Competition for scarce Colorado River water resources is nothing new, but the conflicts that prompted the seven basin states to negotiate the 1922 Colorado River Compact have grown considerably fiercer and more complex in recent decades. The largest known oil shale deposits in the world are in the Green River Formation, which covers portions of Colorado, Utah, and Wyoming. Fully one-half of the world’s oil shale lies within 150 miles of Grand Junction, Colorado, and about 80% of these reserves are on federal land. Estimates of recoverable reserves in the Green River Formation range from 500 billion to 1.53 trillion barrels. At present consumption rates, this is enough oil to satisfy 100% of U.S. demand for well over 100 years.
