Houve tempo em que a Constituição servia para poisar ou charuto ou tirar um argumento político, como ironicamente afirmaria o grande escritor oitocentista Eça de Queiroz. Hoje a Constituição é a norma das normas. Daí há consequências hermenêuticas. Ao contrário das teorias que importam interpretação tradicional e, por vezes, em grande medida ultrapassada, para o Direito Constitucional, a tendência actual é a inversa: dada a supremacia da Constituição, deve ser a metodologia constitucional a exportar hermenêutica para o todo do Direito. Para isso, começamos neste artigo com grandes princípios de hermenêutica intra-constitucional. Depois se passará à exportação.

The authors undertake a detailed analysis of data from the 2006 Census. The data reveal that a substantial proportion of Australia's 18 to 20 year olds are not participating in any form of education. In addition, of those non-attendees, labour force participation is also remarkably low. A supplementary table to the report, which shows education participation rates by Australian federal electorates is also available.

The influence of socioeconomic status on academic outcomes has been well documented in literature exploring post school pathways. Such accounts of educational disadvantage exist in relation to Melbourne, Australia as they do in other cities across the developed world. However, over the past decade in Melbourne there has been an increased stratification of educational outcomes that cannot necessarily be explained by any parallel increase in social inequality. The purpose of this chapter is to theoretically and empirically capture the cultural divide between education and sport and entertainment in American society. The NCAA Academic Reform Movement has evolved from holding individuals accountable to presently monitoring institutions and their retention and graduation success of college student athletes. This movement will require a deeper examination of how culture influences academic attitudes and lifelong learning. Based on empirical data from different methodologies, this chapter proposes that student athletes; especially African American males, are often stereotyped with few strategies to empower their academic and athletic identities. Studies have examined the impact of environmental variables on academic achievement among student athletes in the revenue-generating sports of men’s basketball and football. However, while evidence concerning the positive impact of male student athlete and faculty interaction is virtually unequivocal, we are not certain whether the benefits accruing from particular types of interaction vary across different racial/ethnic groups. This study explores the relationship between male Black and White student athletes and faculty as well as the impact of specific forms of student athlete– faculty interaction on academic achievement. This report seeks to provide a portrait of schools serving rural communities in northwest China, and to shed light on factors that encourage and discourage school persistence among children in this region. To achieve these goals, we analyze a survey of rural children and their families, schools, and teachers in Gansu province. The project interviewed children in the year 2000, when children were 9 to 12 years old, and again four years later.

En base a una encuesta organizacional aplicada a 2,697 estudiantes de una universidad pública estatal se identificó la perspectiva de los mismos sobre la institución (infraestructura, gestión, actividades de docencia, etc.) y su trabajo como estudiantes. En general, los estudiantes manifestaron una opinión positiva de la institución excepto en relación a los asuntos relacionados con el gobierno institucional. Los resultados se discuten en cuanto a su aportación a nuestra comprensión de la vida estudiantil.

The purpose of this study is to explore key factors that impact the college transition of aspiring underrepresented minority students in the biomedical and behavioral sciences, in comparison with White, Asian students and non-science minority students. We examined successful management of the academic environment and sense of belonging during the first college year. Longitudinal data were derived from the Higher Education Research Institute’s (HERI) 2004 Cooperative Institutional Research Program (CIRP) Freshman Survey and the 2005 Your First College Year (YFCY) Survey. This paper explores both the obstacles and the possibilities for students developing identities associated with science by engaging in solidarity-building classroom interactions. Data come from ethnographic research conducted in a diverse eighth-grade urban magnet school classroom in which the teacher taught out of field for part of the year. Contrary to expectations, more students participated and reported enjoying science when the teacher was out of field. Analysis of classroom interactions indicated that while in field, the teacher primarily engaged in “front stage” performances that hid her struggles with the material and accentuated students’ views of science as an elite status …

This study explores the relationship between interaction rituals, student engagement with science, and learning environments modeled on communities of practice based on an ethnographic study of an eighth grade urban magnet school classroom. It compares three interactional events in order to examine the classroom conditions and teacher practices that can foster successful interaction rituals (IRs), which are characterized by high levels of emotional energy, feelings of group membership, and sustained interest in the subject. An important part of learning science is formulating ideas, debating explanations, and talking about science with others. Yet students may still avoid “talking science” in class even if they are familiar with the content knowledge. Drawing on data from an ethnographic study of an eighth-grade urban science classroom, I argue that students’ expressions of knowledge in science class can be considered a strategic move, or a choice, aimed at supporting identity claims and increasing the likelihood of engaging in successful interaction rituals characterized by entrainment and solidarity. After-school education programs for at-risk students are often implemented to increase academic performance and college readiness. This article explores the terms "out-of-school" and "after-school" related to college preparation programs and suggests that these programs should consider attendance, participation and intensity to impact a student's success in college. This article concludes with four practical steps to improve the structural design of after-school programs concerned about college preparation.

The rapid growth in demand for university-trained personnel over recent years has mainly been filled by growth in the skilled migration program. The authors argue that more domestic students should be trained. The Coalition Government does not agree. It claims that 'unmet demand' from prospective university students has been met and that additional subsidised places are to be created. This article scrutinises these claims and concludes that they are not correct. The authors point to a shortfall in domestic higher education training. Using the data from Program for International Student Assessment, I examine the gap in reading performance between 15-year-old students in single-parent and intact families in 5 Asian countries in comparison to the United States. The ordinary least square regression analyses show negligible disadvantages of students with a single parent in Hong Kong and Korea, once students' demographic characteristics and socioeconomic background are held constant. Students in single-parent families in Indonesia and Thailand outperform their peers in intact families. The negative effect of single parenthood remains significant in Japan, even after parent-child communication is controlled. Interpreting the weak effect of single …

Accountability and evidence-based decision-making have become the mantra of government polilcymakers, and even private foundations. Yet most attempts to foster cultures of evidence have not brought about change in Practices, notably because they are treated as management tools rather than learning processes. Equity for All is an approach to accountability that is grounded on the principles of practice theory and sociocultural theories of learning. The authors provide empirical evidence to illustrate practitioner learning.

This paper will attempt to chart a normative framework for action for a social politics of reconciliation via a course for citizens’ action across the ethnic divide of Cyprus. It will attempt to consider the context and content of reconciliation in Cyprus at this time and examine the various ‘routes’ to reconciliation, in terms of locating their theoretical, philosophical and ethical points of reference. This paper aims to connect articulations of ‘racism’ and ‘populism’ within discursive uses of ‘illegal immigration’ in the context of European-wide processes, which frame migrants as the ‘other’: such view have in fact become hegemonic over the recent years. The aim is to connect discourses of ‘illegal’ immigration to social phenomena, such as racist populism in democratic process and debates regarding social citizenship. The examination of the construction processes of exclusionary citizenship, both at European and at national level, via the discourses of undocumented migrant labour is a process that tends to racialise liberal democracy across Europe. The provision of secondary school education in Victoria has changed substantially over the past 50 years. This thesis examines the consequences of these changes for the academic opportunities of government school students. In the 1950s and 1960s, unprecedented numbers of students and near-universal school participation provided a challenge to governments in relation to education provision. As a result, the comprehensive ideal for organising government secondary schooling was adopted. This system became an important vehicle for providing educational opportunities for many students who previously had limited access to the post-primary years.
