Blaine Amendments And The Judiciary: An Analysis Of Government Aid To Religious Schools, Dustin A. Robinson

First introduced in 1875, Blaine Amendments restrict private, parochial schools from utilizing publicly acquired funds. While the federally proposed Blaine Amendment died on the Senate floor, 37 states have adopted constitutional language that limits and/or bars religious schools from receiving public funds. Fraught with bigotry and labeled as discriminatory, such measures have not gone without challenge and the judicial system has delivered numerous decisions on funding public and private schools. However, jurisprudence reveals significant shifts in court decisions over time. Through analysis of Supreme Court cases from Everson v. Board of Education (1947) to Espinoza v. Teacher pay in Arkansas public schools varies widely from district to district across the state. This pay discrepancy is driven by both the funds available to a district and by how these funds are allocated. There is a standard per student budget given to districts across the state, but this budget can be supplemented by additional property taxes collected on property within a district. This leaves districts with more highly valued property at an advantage. Although growth in U.S. community colleges has been exponential, a major challenge accompanying that growth has been the source of funding, which has consisted of shifting proportions of tuition, local taxes, and state aid. The shift away from state aid toward fundraising, profit-oriented research, sophisticated financing, and higher tuition presents challenges and unintended consequences. This shift could threaten the community college access mission and contribute to a perception of higher education as a private good rather than a public good. The present study is built around the following general research question: why is Adventist higher education in a tight budget? This is approached using a comparative time frame analysis of past and present needs and characteristics affecting funding tertiary education. The main idea throughout this paper is that the different funding systems are setting up models of Adventist higher education that aren’t always the best fit for the institutional ideology and organization. Possible alternatives to shift into a more suitable funding system are provided and discusses as well.

This pioneering study draws on literature from both the educational and the nonprofit sectors to integrate the concept of social enterprise with the financial challenges faced by Christian schools. It then explores the receptivity of administrators and board chairmen of Association of Christian Schools International affiliated schools in the Mid-America region to social enterprise based fund raising practices. Findings show that while school leaders are cautious overall, interest varies widely with some school leaders being very receptive and other very opposed to these approaches. Analysis of specific subcategories indicates that school leaders have a greater interest in pursuing opportunities that …

This publication is an attempt to capture the evolution of distributed higher education over the last decade by tracing the applications of new technologies funded by the Fund for the Improvement of Postsecondary Education (FIPSE). As FIPSE surveyed the current state of distance/distributed education, there existed an opportunity to help post econdary education make the transition to this new generation of distance education made possible by the explosive growth of the Internet and other new technologies.
