Towards Quantifiable Metrics Warranting Industry-Wide Corporate Death Penalties, Joshua M. Pearce

In the singular search for profits, some corporations inadvertently kill humans. If this routinely occurs throughout an industry, it may no longer serve a net positive social purpose for society and should be eliminated. This article provides a path to an objective quantifiable metric for determining when an entire industry warrants the corporate death penalty. First, a theoretical foundation is developed with minimum assumptions necessary to provide evidence for corporate public purposes. This is formed into an objective quantifiable metric with publicly-available data and applied to two case studies in the U.S.: the tobacco and coal mining industries. The results …

Responding to the legally guilty is typically presented as a choice between incarceration and rehabilitation.  This paper suggests a third option: preemptive rehabilitation.  The argument presents an innovative institutional approach and a unique moral justification.  The vision is a crime futures market that transfers the risk of potential crime away from undeserving victims and into the portfolios of willing investors.  Instead of taxpayers paying exclusively for prisons, the proposal would allow young adults to sign contracts to not get involved in crime, but pay the award only upon their future success.  Because the contracts represent a future payment they are …

Both engineering and human living take place in a messy world, one chock full of unknowns and contingencies. "Design reasoning" is the way engineers cope with real-world contingency. Because of the messiness, books about engineering design cannot have "ideal solutions" printed in the back in the same way that mathematics textbooks can. Design reasoning does not produce a single, ideally correct answer to a given problem but rather generates a wide variety of rival solutions that vie against each other for their relative level of "satisfactoriness." Why are most capitalist enterprises of any size organized as authoritarian bureaucracies rather than incorporating genuine employee participation that would give the workers real authority? Even firms with employee participation programs leave virtually all decision-making power in the hands of management. The standard answer is that hierarchy is more economically efficient than any sort of genuine participation, so that participatory firms would be less productive and lose out to more traditional competitors. This article introduces corporate historical responsibility (CHR), a concept that can guide organizations when addressing dark corporate histories. CHR holds that organizations have responsibilities toward victims of past corporate practices and toward present reconciliatory discourse. Volkswagen’s discourse about its history of forced labor during WW II serves as an example of CHR. The rhetorical analysis illustrates that CHR hinges on the recognition of the past as a moral issue and on the organization’s ability to create historical accountability, take responsibility, make public acknowledgements, and remember its past. Research into the proper mission of business falls within the context of theoretical and applied ethics. And ethics is fast becoming a part of required business school curricula. However, while business ethics research occasionally appears in high-profile venues, it does not yet enjoy a regular place within any top management journal. Are social marketers really ethical? This essay extends Brenkert’s (2001, 2002) exploration of some of the ethical issues that confront, or perhaps ought to confront social marketers. It contributes to social marketing by adding to the list of ‘mythunderstandings’ offered by Donovan (2011) as follows: social marketing is not inherently and ethically good (even though “social good” is the objective). The implication for social marketing is that the notion of “doing good” needs to be subject to reasonable doubt and critical thinking rather than supported by untrammelled belief.
