Organizational secrets enable firms to protect their unique stocks of knowledge, reduce the imitability of their capabilities and achieve sustained competitive advantages (Hannah, 2005). In today’s business environments, the loss of valuable proprietary organizational knowledge due to intentional employee disclosure represents a substantial threat to firm competitiveness. Anecdotal evidence suggests that firms in the United States lose more than $250 billion of intellectual property every year, with intentional employee disclosure accounting for a significant portion of these losses (Dandliker, 2012; Heffernan & Swartwood, 1993). With respect to university technology transfer, the purpose of this paper is to examine the literature focused on the relationship between university research faculty and technology transfer office staff. We attempt to provide greater understanding of how research faculty’s personal values and research universities’ organization values may differ and why. Faculty researchers and tech transfer office (TTO) staff are perceived to be virtuous agents. When both are meeting each other’s needs, a “love” relationship exists. In 1978 the United States (US) Congress passed the Airline Deregulation Act, allowing all-cargo airlines to compete in an industry that was heretofore highly regulated and stagnant. As companies came and went, successful carriers realized that innovation was necessary to survive. This study analyzes the dynamics of innovation over the industry’s life cycle using intellectual property (IP) data. Results indicate that despite having the characteristics of a commodity, the industry follows a reverse life cycle. Furthermore, FedEx and United Parcel Service (UPS) hold the highest levels of innovation while dominating the market, signifying that innovation should be integrated into the …

People tend to use brands and marks interchangeably due to their similarities. However, they are often nonsubstitutable to each other. This paper systematically examines the similarities and differences of these two terms in conceptual, operational and methodological manners taking account of history and international dimensions. Such clarification is important given the increasing significance of marks and brands for all stakeholders (rather than consumers only). In 1995, the Department of Justice (DOJ) and the Federal Trade Commission (FTC) adopted new guidelines for the licensing of intellectual property rights without violating antitrust laws. The 1995 Antitrust Guidelines for the Licensing of Intellectual Property (IP Guidelines) state the antitrust enforcement policy of the DOJ and the FTC.1 The IP Guidelines drafted by the DOJ and FTC (the agencies) does not provide practitioners with a sufficient level of comfort as they attempt to predict the enforcement initiatives relative to intellectual property licensing.2 The IP Guidelines are inadequate because they misunderstand the nature of intellectual property markets and provide …

In 1995, the Department of Justice and the Federal Trade Commission adopted new guidelines for those wishing to license intellectual property rights without violating antitrust laws. Designed to provide clarity, these guidelines instead breed confusion because they misunderstand the nature of intellectual property markets and provide insufficient guidance in the most difficult areas. Section I of this article will discuss the basic provisions of the guidelines, especially their treatment of "innovation markets." It argues that government enforcers should focus primarily on activity that creates entry barriers. Understanding the use and misuse of licensing is the key to analyzing barriers in …
