Conventional wisdom has long perceived the patent and tort systems as separate legal entities, each tasked with a starkly different mission. Patent law rewards novel ideas; tort law deters harmful conduct. Against this backdrop, this Essay uncovers the opposing effects of patent and tort law on innovation, introducing the "injurer-innovator problem." Patent law incentivizes injurers --often uniquely positioned to make technological breakthroughs--by allowing them to profit from licensing their inventions to competitors. Yet tort law, by imposing liability for failures to invest in care, forces injurers to incur the cost of implementing their own innovations. When the cost of self-implementation …

COVID-19 has transformed the way we live and work. It has caused the processes and operations of businesses and organisations to be restructured, as well as transformed business models. Working With Smart Machines: Insights On The Future Of Work, Thomas H. Davenport, Steven M. Miller

In this article, we share our observations on how and why AI-based systems are being deployed. We look at how these systems have been integrated into existing and new work processes, especially the implications for the changing nature of work and how it will be conducted in future with AI-based smart machines. This will help companies that are in the earlier stages of considering, planning, or deploying these systems to know what to expect from recent developments in practice. We draw our analysis from 24 case studies that we have recently completed on AI system usage in actual operational settings.

Over the course of three to four decades, most well-established companies lose their dominating position in the market or fail entirely. Their failure occurs even though they have resources for sensing shifting market trends, skills and assets to develop next-generation technologies, and the financial means to fill skill gaps and afford risky investments. New Media is defined not by the technology that it is based on but rather on individual level attributes that contribute to the development of new artifacts, practices and social arrangements. However, existing technology adoption models tend to stress technology and organizational level attributes over such individual level characteristics.
