EXECUTIVE SUMMARYFor decades public administration and management scholars have conceptualized organizational networks as solutions to failures of markets and hierarchies (see, for example, Goldsmith and Eggers 2005; Osborne and Gaebler 1992). Relationships among organizations or actors within a network are framed positively as channels through which human, financial, and knowledge resources flow to address complex or “wicked” social problems (see, for example, Rittel and Weber, 1973). Introduction: The Affordable Care Act (ACA) increased access to health insurance throughout the United States. To date, an estimated 20 million previously uninsured individuals have gained access to coverage since the expansion. As a result, the number of fraudulent schemes reported has been on the rise. Among the many fraudulent activities in the healthcare sector, abuse of pharmacy benefits has been the most prevalent. The misuse and abuse of opioids, and opioid related overdoses has created a widespread epidemic throughout the country, thus extending opportunities for potential fraud within the pharmaceutical industry.

The Affordable Care Act (ACA) has proved to be a contentious regulatory and political topic. Although key features were established within the law the complexity of the new provisions and political opposition resulted in a series of federal and state governmental process changes, rule clarifications, and legal challenges. One component of the ACA is the introduction of a federal Medical Loss Ratio (MLR), which requires insurers to spend specified percentages of their premium revenue dollars on medical services and quality improvement actions. This qualitative study examined the impact of high cost CalPERS medical plans on the participant’s school district in regards to the 2020 Cadillac Tax, the types of administrative action the participants have taken to comply with the mandated reporting to the IRS, and the types of administrative measures the participants have taken to comply with the offer of coverage to employees working a minimum of 30 hours per week. Passage of the Patient Protection and Affordable Care Act (PPACA) in 2010 prompted the question of how independent businesses may react to the employer mandate in the PPACA. The law is based on the theory of managed competition and it is more likely to affect businesses with fewer employees than to affect larger businesses that already offer health insurance.
