New Deal labor policies were designed with the stability of the capitalist economy in mind. Their pro-union provisions responded to labor militance and served to head off the formation of a radical working-class movement. The National Labor Relations Act established procedures which encouraged unions to pursue peaceful collective bargaining rather than a more activist course. Although the enforcement of pro-union policies was weak, the fact that they were adopted gave the impression that the state was sensitive to worker interests. [Excerpt] The Justice for Janitors campaign was conceived during a bitter labor dispute with Pittsburgh's Mellon Bank which started late in 1985. Mellon Bank, having just renewed an Service Employees International Union collective-bargaining agreement, replaced their former cleaning contractor with a nonunion company. The new contractor refused to honor the Mellon-SEIU labor accord and was willing to hire only half of Mellon's 80 janitors on a part-time basis with a substantial pay cut and no benefits. Mellon disclaimed any responsibility, stating that the dispute was strictly between the new cleaning contractor and the janitors. In response the SEIU called a …

The AFL-CIO and Change to Win have learned to co-exist without debilitating acrimony. The AFL-CIO has established Industry Coordinating Committees to facilitate cooperative bargaining and organizing ventures. On the political front, the AFL-CIO took the lead in labor’s 2006 electoral operations and conducted an extensive, efficient, and unified campaign. Change to Win unions worked together to build strategies for a growth agenda. The success of UNITE-HERE’s Hotel Workers Rising Campaign indicates the potential of this approach. Difficult challenges remain, but the strategic developments show signs of life and offer hope that labor may find a path to the future.

[Excerpt] This monograph focuses on a relatively under-researched topic, namely, the effects of nonmonetary eligibility rules for both initial receipt of benefits and continued receipt once benefits are granted on the rates at which UI benefits are denied to applicants. The authors very competently employ both econometric and case study research methods to address these issues. Their econometric work utilizes quarterly state-level data between 1964 and 1981 and a fixed-effects framework to isolate those parameters of state unemployment insurance laws that influence denial rates. Although researchers adopting this focus have rightly criticized much of the existing empirical research on the role of human motivation in entrepreneurship, we believe that the development of entrepreneurship theory requires consideration of the motivations of people making entrepreneurial decisions. The Effectiveness Of Reinstatement As A Public Policy Remedy: The Kohler Case, John Drotning, David Lipsky

This article is concerned with two aspects of the NLRB reinstatement remedy as applied in the famous Kohler case: (1) how effective the remedy was, particularly in terms of the number of employees who returned to Kohler under its protection, and (2) what factors, in order of significance, affected a worker's decision to return. The authors find the remedy was effective, since about 40 percent of those workers who received reinstatement offers accepted them. Regression and discriminant analyses of the variables affecting the decision to return confirm the thinking of labor market economists that the most disadvantaged worker (lower paid, …

Following its decision to close four plants and transfer their operations to a new location, the General Foods Corporation offered jobs in the new plant to all 1,800 affected employees and payment of their transfer expenses. To those electing not to transfer, the Corporation offered severance pay. Less than a fourth of employees transferred to the new location. This study analyzes in detail the characteristics of the movers and nonmovers and the subsequent employment experience of the latter. This article identifies and explores the dilemma of migrant advocacy in advanced industrial democracies, focusing specifically on the contemporary United States. On the one hand, universal norms such as human rights, which are theoretically well suited to advancing migrants’ claims, may have little resonance within national settings. On the other hand, the debates around which immigration arguments typically turn, and the terrain on which advocates must fight, derive their values and assumptions from a nation-state framework that is self-limiting.
