Party autonomy in international arbitration is the most compelling reason for the contracting parties to enter into arbitration agreement, rather than opting for litigation. However, arbitration functionalities may be hindered by several factors, one of which is 'arbitrability and public policy'. The 1958 United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards provides arbitrability and public policy as the grounds for refusing the recognition and enforcement of foreign arbitral award for signatory states, thus allowing national courts to use their own discretion when determining the scope of these two issues.

The United States economy has been under the microscope for the last 4 years due to an economic recession. Outsourcing has been a subject of interest that has been brought up numerous times by economists. Mandatory Adoption Of International Accounting Standards In Germany: Financial Statement Effects, Sarah Wagemann

This paper addresses the mandatory adoption of International Financial Reporting Standards (IFRS) in Germany in 2005. The financial, statement effects and the variability of key accounting measures are analyzed under the German Commercial Code (Handelsgesetzbuch - HGB, German GAAP) and IFRS. I find that book value of equity and net income are slightly larger under IFRS than under German GAAP which reflects the fair value orientation of IFRS. Only weak evidence exists that the mandatory adoption of IFRS results in significant accounting differences unlike the results found in financial statements of German firms that voluntarily adopted IFRS.

The 17 "rare earth elements" are essential for the development of new technologies. Over the last several decades, China has established a virtual monopoly on the rare earth industry, producing over 97% of the world's current demand. This was achieved by effectively undercutting other producers who stopped competing in this market. In 2010, in an effort to bolster its domestic market, China decided to reduce the amount of rare earth elements that it would export. In this study, I analyzed the effect of the Arab Spring on the development of social ventures in the MENA region. Using a case study of Morocco, I tried to evaluate in which proportions the new Islamic governments transformed the social venture development context. After a detailed review of the Arab Spring and current literature on social ventures, I conducted a series on interviews of miscellaneous actors of the political, economical and social life of Morocco.

This dissertation uses spatial econometric technique to investigate the role of spatial interdependence/third-country effects on Multinational Enterprises (MNE’s) for affiliate location choice, spillover effects of foreign direct investment (FDI) determinants, and the economic growth of developing countries. Unlike non-spatial models, the advantage of spatial econometric models lies in their ability to capture cross-country interdependence and spillover effects of explanatory variables.
The first essay employs a spatial autoregressive model and data on U.S. outbound FDI to investigate whether U.S. FDI into Africa, Latin America and the Caribbean (LAC) depends on previous U.S. FDI in these regions. Additionally, the study investigates the …

The response of some Argentine workers to the 2001 crisis of neoliberalism gave rise to a movement of worker-recovered enterprises (empresas recuperadas por sus trabajadores or ERTs). The ERTs have emerged as former employees took over the control of generally fraudulently bankrupt factories and enterprises. The analysis of the ERT movement within the neoliberal global capitalist order will draw from William Robinson’s (2004) neo-Gramscian concept of hegemony. The theoretical framework of neo-Gramscian hegemony will be used in exposing the contradictions of capitalism on the global, national, organizational and individual scales and the effects they have on the ERT movement.

This dissertation investigates three aspects of banking foreign direct investment (BFDI). One striking development in the banking sector over the past two decades is the significant increase in BFDI. Multinational banks are now major players in the global financial system in terms of their asset positions, loan amounts, and operational scales. Despite this significant trend in BFDI, few empirical studies exist explaining observed international BFDI trends.

The Mann-Whitney statistics have commonly been used as a building block for many tests involving ordered and umbrella alternatives. Such tests are based on pair wise information that is obtained from all Ck 2 pairs of samples. This dissertation introduces a new nonparametric test for testing umbrella alternatives in a completely randomized one way design. This test is based on information obtained from a subset of the Ck 3 trios of samples.
