"Flaw-Backs:" Executive Compensation Clawbacks And Their Costly Flaw, Connor Douglas Maag

Saving money should not be expensive. Compensation “clawbacks” are a legal mechanism for companies to reclaim employee compensation, but the legislative framework is complex and disorganized. There are four primary federal claw-back provisions: Sarbanes-Oxley § 304, Dodd-Frank § 954, 12 U.S.C.A. § 5221(TARP), and Dodd-Frank § 956—as well as voluntary contractual clawback policies. This comment untangles the web of clawback legislation by overlaying each clawback mechanism to extract a single, clear, and concise description of executive compensation clawbacks, called the “Comprehensive Clawback Coverage.” The Comprehensive Clawback Coverage reveals a major flaw in the legal and regulatory framework: clawbacks increase agency …

This paper details an exemplar case of partnership and philanthropic engagement, positioned to fundamentally transform the means and expectations associated with the employment transition experience for veterans. The vehicle for this transformation is an innovative transition initiative called Onward to Opportunity (O2O). The design, development, and evolution of the O2O program has been supported by early investment and prolonged commitment on the part of philanthropic partners—led by the Schultz Family Foundation—alongside close collaboration with JPMorgan Chase & Co. as well as other public sector and employer partners. Virtual reality (VR) is an emerging technology that has already found successful application in a variety of different fields, including simulation, training, education, and gaming. While VR technologies have been considered for use in recruitment practices, available research on the topic is limited. In all stages of the recruitment process, social categorization of job applicants based on ethnicity, skin color, and gender, as well as other forms of discrimination are contemporary issues.
